i'm fuming.....

For those who don't want to read the thread.

1. Stan was taking photos.

2. Stan had snowballs thrown at him (and therefore his gear too).

3. Stan went for a chat with the snowball throwers.

4. One of them threw a punch at Stans face.

5. Stan defended himself.

I'm afraid you've missed out one important fact:

"so i put down my camera and front up to them..." (Stan's own words).

And THAT was his mistake.

Having a chat is one thing, "fronting up" to them is another.

Anyway for my part this discussion is over, for although I agree with a great deal of what many of you have said the simple fact is that Stan was very lucky on several fronts - his gear was undamaged, HE was undamaged, and finally he was not arrested and will not end up in court.

I expect this thread will run and run but my participation is now at an end - good luck to all - and remember - take care out there.

As for all the 'he is a minor' crap, what if Stan had'nt kicked him, what if he had hit Stan and broke his jaw or he fell and knocked his head and was seriously injured, the yob would have been charged then. He got what he deserved and hopefuly learnt his lesson from it.

I was commenting on what happened.. not what if... I was also on the OP side and simply offering caution.. but if you want to call that crap then fair enough.. at least the OP can see my point.
 
Maybe you should have thought a bit more about it then. Throwing snowballs at moving cars is extremely dangerous. Throwing snowballs is OK when it's your mates but not at total strangers. Maybe this is why there is such a lack of respect in today's society.

Totally agree, fine with your mates, but some stranger? I think assault is the correct term for this, if it had been a stick or a baseball bat would that have been ok? Snowballs can be just as hard as a stone ( or may contain stones etc ).
 
i'm honestly amazed people think fighting back was wrong, for some people yes it might not be the wisest as you could come out worse off but if you're up to the task give them a good f*****g kicking they deserve it.

WELL DONE STAN....do to those as they tried to you sir.... i have two sayings in regards to me and my kit.....1 if you can take it you are welcome to it because you will go through hell to get it...lol....2 always pack a roll of gaffer tape and a sharp instrument just in case....lol...

with a quick read of the thread these were two that stuck out I suppose unless i've read them wrong

edit: on further reading it'd appear both have been retracted in some respect

but yeah to the point, good call on giving them a boot. :)
 
i have a 17 year old 6foot rugby playing son and if he did what this youth did to stan i can asure you he would get twice as much at home and i would be calling the police to have a word with my son..

the only thing i have to say is well done Stan for sticking up for yourself but i little part of me says thank god they did not have a knife or some such..
 
Well done Stan. You stood up for yourself in what many would find an intimidating situation. Another well done for showing some restraint and stopping the self defense when you did.
 
They are clearly used to intimidating folk, so well done you for not being one of them. That yoof will now have your swift boot as an embarassing memory for quite some time - it may be the key to thinking twice.

Well done mate, but i think you are lucky.. a group of 16-19 year olds that live near me were throwing VERY large chnks of ice and snaow at cars about the time you were down last.. anyway, one of the cars stopped and the driver had a few words when he stepped out of the car.. i can still hear the words ringing in my head now...

Oh dear, you appear to be a good parent.

I strongly suspect the source of problems like this is people that are not like yourself.
 
I initially thought good on you but it brought back memories of what happened to my friend six years ago.

Briefly, she shouted at a girl who had pushed her daughter over (on a local park). The girl (aged 17) make an allegation to the police which was 'backed up' by four 'witnesses'. (They ALL LIED and said my friend had assaulted the 17yo when she never laid a finger on her).

It resulted in a court case and my friend got a conviction for common assault. That resulted in her being barred from certain jobs for which she was applying. All due to these kid's lies.

I can't tell you what a terrible effect it's had on her.

So sad but that's what some of these compensation/never done a day's work type of low life scum we have these days.

My final word...

I have not said anything on weather the OP was right or wrong.. neither have i offered advice on what the OP should/shouldnt have done... neither have I said what I would do..

My only point of view from the info given was that he didnt know the ages... if it was a 17 year old (in this country that makes him a minor.. a child in the eyes of the law) then no matter if self defence.. given the info given,.. OP could have found himself in a lot more trouble than the 17yo .. its a caution for other togs.. not even self defence will help you in court against half a dozen 17/18 yr olds that say you kicked him for throwing snowballs..(thats what they would say as peter pointed out) the courts dont like minors being kicked.

My point was made with my thoughts for the OP and other photographers... it wasnt a bleeding heart post for the 17 yr old as one moderator accuses me.. it wasnt to say he shouldnt have done it and it wasnt passing judgment in any way shape or form..


what would I ahve done? probably the same as the OP . if thats confusing then you missed my point :)

Stan I'd just like to say I wish more people were like you, it would make some if these people think twice before trying to intimidate (or worse) people.
 
I think that most people agree on here that the young lad deserved a kick in the nads and most would have wanted to do the same (myself included).

What some are missing is the damage that could have been caused to Stan, and I don't mean the physical damage. If the idiot that Stan kicked was under the age of 18 and there would have been Police involvement he could have had a major problem. Kipax is trying to make that point but I don't think some people are getting it. Even a caution, which would be the very least that the Police would look at would possibly cause Stan to have future problems. For example if he needed a CRB to photograph events, or if he wanted to work in any capacity with vulnerable people (Adults or Children).

I work in a number of areas where I need an enhanced CRB. I have been in situations (even yesterday...snow involvement again!) where I would have liked to cause some serious damage to a group of scroats but I know that if I get involved my career of over 20 years could be over. I am not the type of person to walk away from anything, as people that know me would testify to. But I do understand the implications / repercussions of any form of physical involvement with a 'minor' for people's careers, livelihoods etc.

So my view is:

Stan, you did what a lot of people would have wanted to do but watch yourself fella! Sometimes the fallout isn't worth it. Hope the rest of the year gets better :thumbs:

Not at all - what I'm saying is that a kick is out of proportion to being pelted with snowballs - and THAT, I am certain, is how a court would view it.

The kick was in response to being punched not being snowballed.

Courts and juries are a bit more sensible than you might imagine in these matters.

I have to agree with Kev here. It makes no difference if Stan had a Leica or a Zenit. The issue is he was taking pictures and minding his own business. He was then assaulted - twice (snowballed and then punched) and he defended himself. Stan - I'm sorry to hear of what happened.

sam,i don't think anyone is saying that all 17[or any other age]yr olds are all the same...and i know they are not from personal experience of teaching some over the last 25 years[apprentices]...
