I joined Flickr last night, something I hadn't done before because I thought I would have to use my email address as my username, well apparently not, so I joined. :)

I uploaded a few pics and then did a search for the pics, or to my profile, however I was very surprised to find a picture of mine being displayed by someone else. :eek:

Now the pic says it was by me, but it seems to me a Fireworks company using other peoples pics to show some of their displays. I did a search for a company website, and found the same pic in a slideshow, not acknowledged. :nono:

I'm in two minds what to do. :shrug:

I like that they liked the pic, but then they really should have asked.:thinking:

Great pic you shot there, the biggest problem I see is your avatar.... needs a bit of blue in there ;)

Joking aside, maybe you need to have a nice little word in their ears about such a thing as "Permission"!!
 
seems mine isn't on the website, and using it on their flickr page I guess isn't commercial so it fits the license I have on my photos. But you should follow this up redhed
 
Just realised they must have got my shot from off here, as it is credited to Jimmy Lemon - all my Flickr stuff is Tom Holmes or JLProductions. Hmmmm
 
Just send them a polite note reminding them that the image does belong to you and could they have the decency next time to ask before using images without permission. And add that a little link to your Flickr page wouldn't go amiss either under the image ;)
 
'They' are most likely reading this ;p. And should be aware that I'm a Liverpool resident (and photographer) and could probably undercut petecarr/Jimmy_Lemon/redhed17 should they need a photographer in the future :lol::bonk::bonk:.

On a more serious note, is this a case of image theft/copyright infringement?.

I can't say I have any sort of license on my pics. :shrug:

As I said before, I'm not sure what to do. Maybe I'll give it a few days to see if they respond to the comment I left on 'my' pic. :lol:


PS. If I could get more red in the avatar without diminishing the logo, I would Paul. ;)

But then they would all be taken with that 50mm lens wouldn't they. ;) :lol:

haha ok, well i will leave it there so we dont go into a red or blue rant and end up being sent to another forum!! lol

You got a great ground though, went there last year for a friendly and had a quality weekend, look forward to our next fixture (just for the saturday night though, not the footy, far too hungover to pay attention to that) sauchihall here we come! lol

Sorry I have to confess, I haven't a clue what you are on about :D I presumed the red and blue was footie or sport related, however as far a colours go, I prefer GREEN!

haha your right it is football related, and i assumed that when you said go green you were referring to Celtic, then thought it might be Hibs seeing as your in Edinburgh... this is what happens when your resigned to the fact that you are staying in on a saturday when all you want to do is go out on the lash but the missus puts the kaibosh on it!!
 
Was the picture that you took one of the Company's displays?

If it was it could throw up some interesting copyright issues. If it wasn't, then why are they using another company's firework display to promote their own business Hmmmm?

I think the pic was of one of their displays, specifically the Liverpool 800th Anniversary display. I see what you are saying about copyright, and the thought of a copyright battle is quite amusing. :D

I'm going to wait till Monday night to decide what to do, if anything. I'm giving them over the weekend to reply to the comment I left at Flickr. You never know though, they may be out setting off fireworks. ;)

Could depend what Jimmy_Lemon decides to do though, if he takes them to the cleaners, I'll have some of that. :lol:
 
Its interesting as they have lots of pictures on their site, various events, if they are all nicked then perhaps someone like trading stds would be interested in the working practices of their Web designer ?

Legally I don't really have a case as they haven't really used my shot in a commercial sense (though not sure if their Flickr page can be classed as commercial). With the creative commons license I have on my Flickr photos I allow it to be re-posted as long as it is credited, which they sort of did.

The fact I think they got it from here and not flickr and their is no license on here, so therefore is breach of my copyright then I guess there is a case, but to be honest not something I would bother fighting for just one shot on Flickr :( Might ask them to make the credit a link to my Flickr account though.
 
Jon Culverhouse, the company MD, has his own shots on their Flickr, so safe to assume he's responsible.
 
I've heard it said that David Hoffman allegedly makes more money from sueing people who have stolen his pics than from repro fees ....

But seriously, this is a copyright issue and it is illegal to steal someone's images. A letter to that effect, in the first instance from yourself, jimmy, should get the ball rolling.

Failing that there may be more stuff on the epuk website about where to go next.
 
I have just found some (more) of my images for sale on Photobucket. Whilst they will remove them is there anyway of contacting the person who put them up via the site (I am not a member of photobucket/flker etc but keep finding my images there)

Piclens which is an addon to Firefox is an excellent way of finding images in these various places
 
Thats why i wouldnt jooin a gallery site which didnt allow right click protection

It will stop someone who doesn't know much about computers from stealing images, but if someone is skilled enough to build a website, they'll know how to take a photograph from a site with protection.

The only defence is a very obvious watermark. A low opacity one can be edited out quite simply. I'm sure you've seen school/event photographs with a huge red SAMPLE printed diagonally across them.

The only other thing to do is to only upload 70dpi, 600px wide images, in the hope that they'll be useless for print. Could still be stolen and used on a website though.

I'm tempted to post MASSIVE, high resolution photos all over the internet so anyone will download them, and then when I find they've been used, make lots of monies :D

It's actually very very simple. Hit the PrtScrn key, then CTRL V into mspaint, and crop.

There are plenty of people in America who do just that. :lol:

To the OP:

what I would do is send them a polite email thanking them for the interest in your pic and enclosing a bill for it's use ;-)

Failing that you report them to Flickr and the host of their website, who should get them to remove your image. There is an internet-specific law prohibiting the use of stolen pics which i've used in the past. I'll try and remember what it was called and post a link...

I won't go into details, but it's really really simple, and anyone who's even read the most basic book on web design could have every photo off your website, and I think it's a given that anyone who's designing a catalogue or website would know how to do this.

If you still don't believe me, ask me to PM you a link to any given image on your website, or post the EXIF data up here.

Yes but what im saying is the stuff people can actually buy has good protection-the high res stuff. All other images are in low res and watermarked as stated.
 
Every image you look at is saved on your windows PC, you just might not know, You just have to know where to look for them. Then there are site ripper programs, that will take every single file with just one URL. Not letting you right click and save an image is just a minor inconveniance.

If you haven't given them permission to use it commercially, or even non-commercially just get in touch and ask whats going on.
