Yes, maybe they would. But in this case they didn't just hit one of the burglars with the bat, they hit him with enough force to cause permanent brain damage and for the bat to break into 3 pieces. This also occured in the street following a pursuit. :shake:
I've no sympathy for the burglar or the burgled in this case. Their response was disproportionate to the situation and well beyond what the law allows.
Good, serves the burglar right. He wont be nicking stuff again!
In my mind if the criminal threatens me or my family i will do everything (and anything) that is possible to protect them.

I totally agree and would do the same, but in this case the threat to himself and his family was over. He pursued the burglar to exact revenge. That is why the conviction wasn't quashed, merely the sentence reduced on appeal. His brother, who also took part in the attack, is still in prison.
I'm not out to protect low life scroats and scum, far from it. BUT, this was two brothers who sought and exacted a brutal attack afterwards and not in defence of themselves or their family.
edit: As an afterthought on this, how would you react if a thief tried to snatch your camera whilst you were out doing a bit of togging. Having deterred him with perhaps a thump forcing him to flee, would you then follow him and beat his brain to pulp with your tripod (breaking the tripod and causing him brain damage in the process). That, in essence, is what these two brothers did.
Still think that's a good thing? What if they'd mistaken you for their attacker and caused you brain damage? Still a good thing?
Sorry, but nothing about this case is "good", not for them, the burglar, nor society in general.![]()

This has just been on the news on tv. Seems the fella with the brain damage has recovered enough to resume his life of crime.:shrug:

If they'd burgled my house and held my family at knife point I'd be mad as hell too.
The only mistake they made was hitting them on the head and causing brain damage, which is indeed disproportionate. Far better to have broken their legs... twice.

If my family was threatened like this I know I would not be thinking straight. If I caught someone in my house they I would attack them like crazy, no point giving them a punch or two, getting up and then they attack you!
And in your house while your life is being threatened you wouldn't even face charges, even if they died as long as they were coming towards you and you felt your life was in danger
Chasing them up the street and beating the living crap out of them while they're running away is illegal, you're no longer under threat, if they die while you're beating them that would be murder which means as well as their life being over so is yours.
We'd all like to think we'd do anything to protect our family but if this kind of action is allowed to go unpunished we'd be going back 200 years to the wild west where lynch mobs are the norm.
What's needed is more prisons and longer sentences so the public feel safer, if you're going to make a law enforce it, a guy I know is a drunk driver, he got caught and banned, got his licence back then he did it again and got banned for 3 years, he was terrified of the fine which was up to £5000, he earns 30k a year, they fined him £500.
What's the point of having a £5000 maximum fine if someone on 30k a year only gets fined £500 :shrug:
If they'd fined him 5k he may have though i'm not doing that again, the ban doesn't worry him but taking £100 a week out of his wage packet for a year would
