ive just heard the man that got tied up and threatened with a knife in his house ,then managed to escape , chased the scum down the road and battered him with a cricket bat has been free by the court of appeal .

Yes, maybe they would. But in this case they didn't just hit one of the burglars with the bat, they hit him with enough force to cause permanent brain damage and for the bat to break into 3 pieces. This also occured in the street following a pursuit. :shake:

I've no sympathy for the burglar or the burgled in this case. Their response was disproportionate to the situation and well beyond what the law allows.

Yep agreed. This was vigilantism. Not protecting his family or some such.
 
good. the law in this country stinks. if that man had done the same thing in any other country he would have been branded a hero (which imho he is). but no not here. In my mind if the criminal threatens me or my family i will do everything (and anything) that is possible to protect them. When a criminal comes into my house and shows and has no regard for our lives, i will not have any regard for his.

I totally agree and would do the same, but in this case the threat to himself and his family was over. He pursued the burglar to exact revenge. That is why the conviction wasn't quashed, merely the sentence reduced on appeal. His brother, who also took part in the attack, is still in prison.

I'm not out to protect low life scroats and scum, far from it. BUT, this was two brothers who sought and exacted a brutal attack afterwards and not in defence of themselves or their family.

edit: As an afterthought on this, how would you react if a thief tried to snatch your camera whilst you were out doing a bit of togging. Having deterred him with perhaps a thump forcing him to flee, would you then follow him and beat his brain to pulp with your tripod (breaking the tripod and causing him brain damage in the process). That, in essence, is what these two brothers did.

Still think that's a good thing? What if they'd mistaken you for their attacker and caused you brain damage? Still a good thing?

Sorry, but nothing about this case is "good", not for them, the burglar, nor society in general. :(

I am in agreement with Hepburn. This wasnt self defence this was revenge and you cannot blame the current laws for taking action against this man.

I'm sure he didnt mean to cause brain damage and I am assuming the court has taken into account his mental state at the time and that is why they have given him a suspended sentence.

The burglary is probably something that would have had an impact on him and his family for quite a while but his family were safe after the burglary. He worsened it by leaving his family to pursue revenge and ended up in jail not able to support them, not to mention the brother's family. I doubt it was worth it but I am glad that he is free and can hopefully get on with his life, Im sure this has all been punishment enough.:(
 
Lots of ifs and buts here, but the guy could have returned later and done harm to the family in revenge for being disturbed and maybe getting a light slap - who knows what might have happened if the relative had not turned up when he did? What about the trauma to the family.

If my family was threatened like this I know I would not be thinking straight. If I caught someone in my house they I would attack them like crazy, no point giving them a punch or two, getting up and then they attack you!

At the end of the day, if you choose to break the law you run the risk of something going wrong, you go joyriding theres a chance you will crash and be killed - you burgle and theres the risk of the owner beating you up.
 
so three balaclava wearing ,thugs with knives tie up his wife and family members ,and they're burglars? not in my book .i'd be happy to see the low life scum executed .

The court's decision was undoubtedly right IMO. What use would a prison sentence serve?
A punishment? I'd say he and his family had been traumatised and punished enough already.
Keeping a dangerous man off the street? He's hardly a risk to the general public.
Rehabilitation? It's not a crime that he's likely to commit again.
A deterrent to others? I would say that this case is unlikely to be at the forefront of anyone's mind if they found themselves in the same situation.

It would just be a completely pointless waste of tax payers money.

Was he right to pursue and attack one of the burglars?
Probably not. But if masked men broke into your house, then tied up and threatened your wife & children at knifepoint, I don't think many people would argue over whether or not they deserved a good kicking.
And to be fair, it sounds like a well organised professional job. If he hadn't pursued him there's a good chance that the police would never have found the attackers.

My issue is the strength of the attack . . . enough to break the bat and cause brain damage. :shake:
I can see how adrenalin would take over in that situation, with scenes of his wife & kids still in his head, and I doubt that moderating the blows was top of his agenda.
Doesn't make it right, but it is understandable . . . mixed feelings from me here.

I think the real tragedy is that a family has been left torn apart and there will be no justice for the scum that did this.
If I remember correctly the injured burglar is unfit to stand trial and his two accomplices made a clean getaway . . . with him unable to be questioned about their identity.

If he had just cornered the burglar and used enough force to restrain him, he would have been hailed as a hero and there would be 3 people behind bars who thoroughly deserve to be there.

Do you believe that the infliction of brain damage is the appropriate punishment for burglary?

No lets do what they do in Saudi...............cut their hands off.......simple solution, they wont do it again:thumbs:

Adrenalin does kick in and make the most sane person do things they would never even think about, makes you think doesnt it.......bring back capitol punishment is whats needed............a bit of a deterrant

You should write to your MP and suggest it.
We are in a recession and that's got to be far more cost effective than 2 years bed and board.
In fact you'd probably even get some volunteers to do the chopping for free. ;)
 
If this had been done within the persons house then I would totally agree but as the attack happened down the road then I think they took it way too far. I am all up for people having the right to defend themselves from a threat in their own homes but once outside and the threat has gone get the police involved.

These guys caught up with the burglar so why not just detain him until Police arrived. They took matters into their own hands and that is not right.

If the deterant was far greater for getting caught then maybe less people would take to ruining others lives by stealing from them.

Couldn't agree more. You pays your money you takes your chance. Dont run the risk of brain damage by choosing not to burglarize and terrorize a family.

If they'd burgled my house and held my family at knife point I'd be mad as hell too.
The only mistake they made was hitting them on the head and causing brain damage, which is indeed disproportionate. Far better to have broken their legs... twice.

I think he went to far, but maybe the thought in his head was that if he did just stop and hold him till the police came, they might just arrest him and his brothers instead for harassing the poor burglar in pursuit of his job to support his family..............

I agree fully, a hit to the head is ALWAYS disproportionate due to the possible outcome, but I can understand the reason for giving chase, the adrenalin and anger would have kicked in and secondly, to stop them getting away because once out of sight, the police will struggle to find them. At least with a broken leg or two they won't be going anywhere fast!

or maybe not... Using your course of action what happens if you succeeded and the scumbag's relatives then retaliated and came looking for you and your family - with the same intended course of action? Where and when does it stop?

And in your house while your life is being threatened you wouldn't even face charges, even if they died as long as they were coming towards you and you felt your life was in danger

Chasing them up the street and beating the living crap out of them while they're running away is illegal, you're no longer under threat, if they die while you're beating them that would be murder which means as well as their life being over so is yours.

We'd all like to think we'd do anything to protect our family but if this kind of action is allowed to go unpunished we'd be going back 200 years to the wild west where lynch mobs are the norm.

What's needed is more prisons and longer sentences so the public feel safer, if you're going to make a law enforce it, a guy I know is a drunk driver, he got caught and banned, got his licence back then he did it again and got banned for 3 years, he was terrified of the fine which was up to £5000, he earns 30k a year, they fined him £500.

What's the point of having a £5000 maximum fine if someone on 30k a year only gets fined £500 :shrug:

If they'd fined him 5k he may have though i'm not doing that again, the ban doesn't worry him but taking £100 a week out of his wage packet for a year would

Totally agree :thumbs: Having said that, It could be argued that someone suffering the rage that he did, as would I in that scenario that he was actually mentally unstable for those few minutes when he revenged his attack .. :thinking:
 
I`m all for looking after your family and possesions, but these guys chased him up the street,understandably in anger, caught him and then hit him so hard as to break a cricket bat in three places.

Come on guys,that is a bit OTT,surely?
