Advice for problem on eBay

Okay,

Last year, end of September time, I bought a lighting kit off ebay. When it arrived i noticed there were parts missing, but, in the kit was an extra umbrella which the seller had accidently included instead of the other parts.
So I contacted the seller, I sent back the umbrella, and I was awaiting the other parts. He said he'd get them sent out.

I'm still waiting.... the seller has ignored my emails in the past, so I've had to make phone calls to them to remind him he hasn't sent out my equipment. Usually get fobbed off with an excuse like "im away with work at the moment"

Finally spoke to him on the phone about 1 month ago, and he said he has lost the parts, but would go to Calumet to purchase them, and send them.

Emailed him yesterday demanding the parts to be sent out, I priced up each part and said he either sends them out, or makes a partial refund.

Got a reply today, he's asking if I can send the whole kit back and he'll refund it all, which I am NOT doing, as the kit is in use, and i don't have time or the money to buy another kit to replace it.

As the sale was around 4 months ago, ebay/paypal can't do anything, which I understand, because the problem should have been sorted ages ago.

Can anyone advise me on what to do?

either accept the offer of a full refund or suck it up and purchase the bits you need yourself and write it off as experience. I think the offer of a full refund after so long is fair and good to be honest, even though his handling of the matter has been less than satisfactory up to that point.
 
eBay will say take the refund even if it costs you a fair bit to return the item.
 
Thats the problem, i think ebay give around 45 days in which to claim. But its very easy to go over these 45 days making contact with the buyer, which is what paypal encourage you to do.
So you spend over 45 days trying to sort out the problem with the seller, emails being sent back forth then you realise that you are not going to get anywhere and realise that the 45 days is up! its ridiculous and i despise these rules by paypal.

If possible get the refund before you send the goods out, its a reversal of what happens when you buy something. Explain that you paid him the money (in good faith) before he sent out the item and now you want the money before you send out the item.

I think thats a fair deal!
 
Well, I've sent an email saying either replace the items, or cough up £100 so I can replace the missing items myself.

So if nothing comes from that then i'll probably just let it go, its too much hassle having the send the whole lot back, and then buy another complete kit to replace it.

I bought the kit at a decent price too, and they are around £120 deerer now.
 
On the rare occasions that I've had a problem with an Ebay seller what I do is contact them and open a dispute with Paypal at the same time, leaving notice that should the seller not resolve my issues it will be escalated to a claim, but should the problem be sorted out no claim will be made.

In every case the matter has been resolved, usually within 48 hours...
 
I wouldn't send the kit back, you're already potentially out of pocket, you might get a full refund but you might not, is it a risk you're happy to take.

I'd try & hold out for the bits, open a dispute, but in my experience I've only ever had two problems of goods not turning up (both reasonably cheap) and I found eBay & PayPal to be a complete & utter waste of space, so I wouldn;t rely on being able to get my money back via them - just my experience, I'm glad others have had better.

After the experience you have had so far I would not trust that person, unless they refunded first.

Maybe the parts have been found, and it was such a bargain the seller wants it back, seems a strange offer if the parts are genuinely missing so either the seller has suddenly had an honesty transplant or it is just my suspicious nature:thinking:.
 
Just put it down to experience, it's not worth losing sleep over, i'd have kept the extra umbrella as well
 
Wether or not you decide to take the refund, open a dispute with eBay first so they know what is going on. That said I'm not sure a dispute would get anywhere because you have been using the phone to contact the seller, unless you have enought written proof for them to go on.
 
If you have a credit card, use it to fund all purchases. PayPal and the CC issuer may deny the fact, but you can claim against the issuer.
