As i asked before even though he was late did he stay till 10.30pm as agreed ??

Are all the photos that you will receive of the reception only ??

Do you have any signed agreement/contract with him explaining what you will receive for your money??

I was supposed to have 2 from 10.30am - 10.30pm. I had 1 from about 2.30pm I think, then another came for the night. He didn't stay all night but the second one did.

Yes, I had a conf email detailing the times, what was included etc.

He managed to make it for the group shots as we had to push the ceremony and the meal back by 15 - 30 minutes so all our canapes were overcooked. Grrrr I get so angry just thinking about it!

I am not a wedding pro (yet!) but if it was me, I would refund all the money & provide the photos on cd/dvd- in fact, anything to keep the client happy!!

I didn't realise you'd payed by CC. One option this gives you is to seek a refund through your CC company and for them to charge back or reclaim from him, but I'd persue the direct refund first as it is a bit of a slow process

We didn't pay by card, they emailed back and said they couldn't process it so we paid by cheque.
 
If you have a contract and it clearly states what you should get for your money and he has failed to deliver on that then you are looking at breach of contract, mention those words if your contract is watertight though and not unless.

Then all you have to do is negotiate a suitable fee for the ones he did shoot ie total price minus albums minus all the stuff he did not do. Basically offer him his hourly rate for when he did turn up!
 
As an incredibly unlaid back person myself, I would be setting out exactly what I wanted - all images on cd, high res, full refund, and a date by which I wanted this (14 days max) and mentioning I would be passing the whole matter to my solicitor if not received.
Check your house insurance policy, these often include legal advice, so you could possibly get some professional advice for free.
I am actually fuming on your behalf, I think the offer of a £325 discount is a joke.

I have to admit I wouldn't even do that, but thats my personal opinion. To me, hes spoiled the day by not turning up for the most important parts of it - the getting ready and the ceremony. In doing so he is in breech of his contract - (IMO you don't need water tight wording for this, he's taken payment and provided written confirmation of what that payment is for) by not turning up when he's said he would.

He didn't offer the £325 - he offered £125!!! I went back to him and asked for £325.

I don't have home insurance...

OK, how about this:

After reading the emails I see I also have 5 x 8x10 photos included in the package. I also think it's hilarious that in the same email confirmation it says 'you have booked the package with Daniel and the extra photographer, this will ensure that nothing is missed from the day.'

Upon reflection, I am so upset about the whole situation and the fact that we have no pictures of the ceremony or the morning (not to mention breech of contract) that I would like to forget about the albums, canvases and prints and be sent a full refund along with the CD of all high res edited images and copyright as a gesture of goodwill. This is the very least you can do for ruining our wedding day. (I'm sure you must have adequate insurance to cover this.)

Can you please confirm and arrange the refund to the following account within in the next 3 days:
 
I'm gobsmacked that he offered £125 for that sort of cock-up.

I'd have refunded the full amount without being asked and taken it on the chin.
 
I cannot think for one moment why you would want to offer ANY payment whasoever. A wedding photographer is there to cover the wedding, surely? If they fail in that, and there are no extenuating circumstances, then that is a clear breach, written contract or not.

Well he has breached the original agreement.

So you only got about 10hours work instead of the agreed 2x12=24hrs cover.

I think you will have to pay to get your photos, but it is coming to an agreement on how much.

I would speak to somebody like the citizens advice bureau, take all your emails and correspondence as most of the advisors have been or are solicitors.

Maybe somebody here might be willing to knock you up an album for a decent rate.

I would go for CD of the photos and go else where for the albums.

Took the pictures at my sisters wedding several years back, disaster!

Arrived late and had to get people to come out of the church and pretend to be arriving :bonk:

THen, when sat in the church during the service I noticed the counter on 32 but I had only purchased 24's :eek: film hadn't caught :bang:

I told my sister in front of the minister so she couldn't swear, it didn't work :nono:

All was good in the end, I was only doing it because they didn't really want any but were happy if I got a few candids or at least thats what they told me :lol:

She lives in Canada now, not spoken for years........
 
Is anybody here in the insurance game and knows exactly what professional indemnity insurance covers ??.

Would the photographer be able to claim for things going wrong ??
 
it is there to cover the photographer for the costs associated with failing to deliver in their professional capacity

In this case when they make this sort of monumental cock up, so they can at their own expense (or in this case the insurances) arrange for a 'Mock' wedding so they can get the shots they should of got first time.

I'm thinking three steps ahead here Hugh. :) (sneaky) The fact that he has turned up for part of it is one thing but the fact that he still has the pics of the rest of the day is my main concern, therefore offering some sort of payment to ensure their swift release would be my priority. Otherwise he might just have a fit and although you get all the money back....no pics!
Don't want that happening so I see a negotiated settlement as the only resonable way to proceed.
 
I've sent the email now so I'll see what he comes back with.

I would suggest you should get at least half the money back as you only had one tog most of the time so £650, then theres the fact he missed the important part of the wedding (the service) so another half refund £325 (as he missed half the wedding effectively), that brings you to around £975 refund. Thats without any compensation for the unreplacable images lost, or the suffering you have have had.
Really he should give you a total refund and the pics at least, if he had any sense he'd do that and call it quits, far better than going to court and maybe getting damages and bad publicity.
 
Our first wedding, two of us. Nice big kirk in Edinburgh, lots of lovely vantage points. We picked the best two. I had the back of the kirk with the 70 to 200, got me a bit of reach. My friend on the other hand got a much closer vantage point, a good angle, he really got into the best area.....at the practice session...

On the day, we shot the guests arriving, and I headed to my patch. He was instructed to a door by the clerk, said door was about 30 seconds away. So, he left the area where we had shot the guests, proceeded outside and around to the door...and it was locked. He came back to inform us, but the door had been locked behind him.

He spent the entire ceremony outside, talking to the photographers who had arrived for the next wedding. We lost the best vantage point, and the clerk nearly lost his teeth :D

Only this past Saturday, the bride wiped the side of her dress on the car tyre and wheel arch, subsequently leaving a black mark all down the right hand side. - she was not happy nor was I) , and I had to 'hide' the mark by positioning the dress in a way to cover it!

I see where you're coming from with this, but it makes me very angry and sad when I read about tog's who make this sort of f&*! up and then don't have the decency to offer a total, no quible refund. You just shouldn't have to negotiate a settlement with somebody who has completely failed to deliver.

I agree that he should pay up. Chances are though, the money was spent the minute he got it, and he scrapes by. If so, there is absolutely nothing other than the stiff arm of the civil court that will get him to part with his cash.

This is an easy one for me... not a mistake on my part (which will become obvious) but the grooms dad died. He was ill anyway, but died between the ceremony and reception (on the car drive over)... try explaining that one to the waiting groom! My first official wedding too, nearly put me off for life!

I would give him a specific period in which to refund, and have him confirm that he'll do this, the exact amount, and the method of refund.

I shot a wedding the other week where the grooms father (without anyone knowing) organised a ** to do 30 minutes during the meal.

Awkward wasnt the word, but in the name of professionalism i took only a few shots of her. Its very hard to do one handed.

I still hadn't heard back so I just text him and said 'please check your emails and get back to me ASAP'

His reply: Sorry I'm at a wedding, also tomorrow and Sunday. Will get a disk out to you next week. Will reply to email Tuesday. Phone call would be best due to hand injury with car crash.

I replied: Sorry to hear about the crash. I would call but I've been advised to keep all correspondance in writing. Maybe * can reply / type on your hbehalf? I'll wait to hear from you.

Now I'm going to have to wait until Tuesday before he even reads my email request of wanting a full refund but no albums etc.

TBH that sounds like bulls*** on his behalf as a reply. If hes capable of working a camera and the associated computer activities with 3 weddings then he's capable of replying. I'm also fairly unsure about his triple header. There aren't that many Sunday weddings (but they do happen)

I felt a bit bad in case his hand really is hurt so I just called and he was really flushered and said he was just in the middle of the wedding so I said call me back when you have aminute.

I am asking for a refund of the £1625 and that I dont want the albums, canvases etc but I do want the CD of all images.
 
OMG just had the most awful coversation ever. I'm still shaking.

He called me back and as soon as I said I wanted a refund he went crazy and started shouting at me really aggressively saying 'I've ruined the wedding day have I? I've ruined your wedding day. I've ruined your whole damn day.' Over and over again at which point I burst into tears. Not to mention the fact he also said 'I'm sick of you hassling me.'

Then said he didn't want to talk about it or to me anymore and that we'll have to take it to court. Then he switched suddenly and calmed down and apologised for flipping out and said he's just really stressed because he's at another wedding and that the pictures are amazing and the albums are such good quality. He then went on to say that he feels so bad about it so much that he doesn't even want to do weddings anymore and that he's going to fire the person I dealt with.

I'm in a complete state of shock. I'm so worried he will just turn around and not send me any at all that I had no choice but to agree to him sending the CDs of the images out and taking it from there.

I found myself apologising at one point? WTF?

Fingers crossed I get a CD with some photos next week.

Regardless of his emotion and yours, he has failed to fulfil what he was contracted to do. That is what togs have insurance for.

I suspect he's now regreting saying he'll see you in court. If I was you that is exactly what I would be doing, he doesn't have a leg to stand on.

Make no further communication with him for at least a few days. Gather your thoughts, then proceed only through written communications, sent recorded delivery. In each instance request a response within 7 days.

I feel very sorry for you that this is happening :( his behaviour is appalling.

Please please, resist the temptation to communicate with him again in spite or whatever. You'll get some good advice here, please take and don't let your emotions get in the way. It might be worth noting down the communications that have taken place so far so you've got a record should you need it.

Priority 1 is getting your pictures. Once they're in your possession it's time to break out the big guns.

Such a shame it's come to it, but DO NOT TAKE THIS LYING DOWN and remember YOU are the client, YOU have acted in accordance with the contract made, and YOU will come out of this better than he will.

I'm happy to offer any further advice that I can, as I'm sure others will.
 
Here's what I'd do:

Lay out in email exactly what you expect him to do. A full refund may not, legally, be deemed to be reasonable as we are talking about non-performance of only part of the contract here. Send the same in letter form, recorded delivery.

In that specify a reasonable time limit for a response, say 14 days. State that no reply to your satisfaction will mean you issue proceedings in the Small Claims track.

And then do it. Give him exactly 14 days and issue.
