I thought it looked very familiar, but it's a popular view so I thought I better double check with my own image.

100% identical. It crops up quite often (last week it was the sole image used for a music video on Youtube, they took it down within hours of me reporting it) but this is the first time it's been used so blatantly for profit.

I've spent about an hour reading up on eBay and it appears as though I need to fax my complaint, who the hell has a fax machine these days?!

Any tips?!
 
Bill them at commercial rates and also report them to local trading standards

Ah, your best bet is to become a multi-national company such chanel, gucci or rolex then you can join their "Vero" scheme where you can have anything pulled on nothing more than a whim.... Rant over.

Seriously though, a scan as a jpg should suffice and then use their document uploader page (request them email you this from their "Trust and safety" department) then keep phoning them, should get it sorted in a day or so.

I'm just an amateur, no idea about rates or what to bill them for. Any tips?

Your concern about rate is immaterial - they pay up or cease and desist.
Stop worrying about being fair - there's no law saying you can only ask this much because of your amateur status.

^^ this, basically. If they'd wanted a decent discount, they should have negotiated it before using your image.
 
have you looked through his feedback it looks like everything he has sold is itemised / listed it would strengthen your case if he has actually sold one of your images

looks like the VW camper is popular :) i wonder who that belongs to
 
that not the same photo, see the tree in the sky on the canvas but on the flickr one ;) but very close and I'd wager all have them have been ripped from flickr ;)

Look at the clouds, though. Different processing on each of the images, but certainly one is a derivative of the other.

flickr says the image is all rights reserved, but that licensing is possible through Getty. Is it possible that Getty has been selling licenses for this image?
 
I think Getty get in touch with the photographer first and invite them to submit.

At least that's what they did with me.

If it was me, I would ask them for 95% of all past and future sales, otherwise see what the lawyers say.... But that is just my personal viewpoint; I know other people would probably throw the book at them!

Ironically it doesn't actually have that many views on Flickr compared to a lot of my stuff.
 
You know the thing that's most interesting to me is the sales he's achieved, I never even thought that something like that could produce sales on that level, not saying my photo's are stunning, but it's almost tempting to set something similar up see if I can generate some sales :D

How about buying the most expensive one off that ebay seller at £72 and then refusing to pay for it. When he kicks up a fuss with ebay you can tell them you're refusing to pay on the grounds that he's selling stolen property. :) That might fix him.

ukaskew - I might be tempted to spend £50 and run this by a copyright lawyer type person.

Be interesting to see what others think about that.

First of all the buyer pays upfront before anything gets sent!
Secondly, the amount owed to uka is considerably more than 72 £1 coins.
The only thing that's going to "fix 'im" is a hefty invoice so that he thinks many more times before pulling the same stunt again.
 
I will keep you guys updated, but I'm going to fire off an invoice tomorrow and see what (if anything) happens.

It's funny, I see people who post photos with watermarks and think 'in a way I wish I was good enough to need to do that', not for a second thinking it would ever happen to me. You live and learn, I guess (not that watermarks are fool proof)
 
I cannot believe the amount of internet space your image has! It's mental! Good luck with the invoice!
 
I assume this image has been infringed from an internet page. If so, at what resolution was it uploaded? I would think that a normal size for internet use would look terrible printed at anything over 6" x 4".

Surely they are't making poster sized prints from the 1024 pixels flickr image?

I would not exp3ect any help from ebay other than a takedown. You will not get them to provide information on number of sales and/or help in getting recompense. They will brush everything under the carpet and delete all history. Make sure you have all teh evidence you need before you involve them.
 
Wow didnt actually realise how rampant theft is from flickr. I dont even have many images on there but just image searched a couple to find they are being used extensively by hd desktop background sites. Pretty annoying, they dont give any credit and although they might not be selling the images im sure the sites make money through ads etc
