Sorry abouts this but its going to be a long one! I need some help and advice regarding a dispute with Nikon.

Way back in June this year, I purchased a Nikon camera from a local Jessops store. At the time, Nikon were advertising the £60 cashback offer that ran untill the end of September. Fantastic I thought!

To claim your cashback you needed to register your camera and lens on their website and then send a receipt and copy of the warranty slip away to them so they could process your request. Sounds easy. I did this, then received an e-mail from Nikon saying thankyou for registering etc bla bla bla but no mention of the cashback. I must have left it several weeks before looking into this again, I rang Nikon and told them I havent heard from them re the cashback and I have not received the ammount into my account.

They wouldnt take any of my details, name, e-mail address to look into my case, and fobbed me off on at least 6 or 7 occasions saying, "Sorry, we have a backlog, if you sent your details into us before the end of September then dont worry", I was prommised several call backs, non of which materialised and I have spent to date, approx £15 on phone calls to them.

Anyway..... Since then I had finally received an e-mail from them advising that the £60 was sent to my account on the 19th September, the money would be sent from Ireland so would take up to 10 working days. (I work for my bank so can check my account every day) 10 Days later and nothing.

I managed to get a contact at Nikon that I could e-mail them keep me updated with the incident. So far I have sent god know how many e-mails, to advisors, managers, almost everyone that works there! Still, you guessed it, no cashback. Each time I e-mail them, I get the same answer avoiding my questions. They have stated that the money was sent on the 19th Sept end of. They wont check my account details, they wont let me send them a copy of my statment to prove the money isnt there.

I am quite totally, utterly, completely ****ed off. I applied for the cashback in June, 7 months ago.

Where do I stand? What can I do?
 
Write (not email) a letter to the head of the dept. dealing with the promotion, the head of customer services and also the UK CEO/MD/Head Honcho explaining what has happened, that you are disappointed with the poor level of service and support and that you expect them to properly investigate what happened to your money.

That should at least get the ball rolling.

Another route would be to apply for any information they hold under the DPA, that should at least get copies of the documents showing details of the transaction.

Seriously tho, that'd p*** me off. Legal action maybe the only answer but for £60 is it worth the hassle. At least threaten them with it and say you're going to write to the press and the photography magazines about the crap service. See if that gee's them up.

Assuming you've complied with the terms of the cashback (time limits, provision of documents etc) then you're entitled to your money. Its the debtor's (Nikon) obligation to seek out his creditor (you). So that fact they say they paid is no defence. Their obligation is to ensure that the money reaches you.
