When Will I Learn???

Her setting the calendar was supposed to be a whole "I understand you're struggling at the moment, so I'll set it to help you out" - I did set one anyway afterwards though, but she'd decided it was her "design" or no design by then.
this implies to me that you were doing a calender and a friend said
"I understand you're struggling at the moment, so I'll set it to help you out"

but in the opening post it was

Took some pics of our children (mothers and children group).
Was asked if they could be used for a calendar. "Why not?" I thought.

which implies that someone else was doing a calender and asked you if they could use you pictures

so :shrug: please make it simple for a simpleton ,,,thank you
 
A group a friends, I took pics of our children, someone made a suggestion for the images I took to be made into a calendar, I agreed that the images could be used as full images in a calendar. I'm confused as to the "exactly which shade of grey was this???" interrogation, someone asked why I didn't set it myself, so out of courtesy I answered..., lol, it wasn't commercial, I'm not a pro, just an amateur tog taking pics for fun. Next someone will ask how much I got paid...(FWIW a couple of huffs from a moody woman...)
 
did you actually say that in writing ? (originally you said that you'd just 'asked her not to crop them' )

I'm sure we all understand that you didnt give away the copyright - but you have essentially licenced her to have non exclusive permission to use them to create a calendar... what i was asking is what if anything you put in writing regarding this licence. (verbal agreements arent worth the paper they arent written on)

If it were me i'd have said something along the lines that "i licence images x, y, and z on a non exclusive basis to Ms x for the purposes of the creation of a calendar for... with the stipulation that the images are not cropped, editted, or otherwise altered during this use "

and that would have been in a written agreement which we both signed

Anything less leaves you open to this sort of thing with very little recourse and opens the dor to he said she said arguments about what was and wasnt allowed

No, I didn't do anything in writing, not formally anyway, just emails/texts saying don't crop and explaining why I don't usually give files to friends, only prints - quality control and numpties with "artistic licence" - hence the title "when will I learn?" ;) lol

so basically you don't have a leg to stand on because she has used your images as full images, she's just added a load of arty cobblers on top - on the whole i'd suggest taking it on the chin and not trying to retract permission now as that will just cause ill feeling and resentment within the group.

In future if you don't want any editing done, you need to spell that out - in writing.

the only other thing to do is to see what the rest of the group think, if they hate the arty b*****ks then you put your design forward, if they love it then smile and move on.
 
No, she took chunks out of the images and cropped heads etc. As in the image posted...and to be fair, the cropping left a fair bit to be desired anyway!! I've made a few silly mistakes...but making an "OKish to a novice" image to a....however to politely describe the earlier image....there's not really any need like....

Don't get me wrong, it'd be futile kicking off more than I have (I've said that the images can't be used like that and wrote a proper usage licence, for future etc) but sometimes I can't believe my own stupidity when it comes to how trusting I am. Laugh, live n learn...

I learnt my lesson a few years back, took a load of pictures at a small local event, the organiser asked if the could use my pictures
on their newsletters/website etc. I agreed as long as they weren't played with and I got some recognition.
I watermarked them all with my copywrite and...........................................they cropped it out :bang:
I did get them removed from the website eventually but too late for the publications which contained a lot of them
They had the cheek to ask me back officially to the next one, yep I refused

I was trying to understand where you are with photography Nat. You had the post the other week about an exhibition you are doing you have posted a few times about shoots you have done (iirc) and then this one. I was a little confused if you are an amateur or a professional and then your about me page blurred the line a bit more to me. That's all it was.

I'm just an amateur, and like to set little projects....and then kinda shout about them - I like to show off my stuff. I personally feel that outright saying so on my website, for some reason, seems to devalue my images to the general public, hence skirting around saying so. The exhibition has been postponed unfortunately (exhibition not in my name, but my pictures were contributing) and I admit that I'm disappointed about that. ;)

Ok... now you know how an artist might use your photographs...
In future you have a choice and can tell your clients exacty what your restrictions are, and how they may use your masterpieces.
However few if any Clients, that I have met in a long working life, would accept those terms.
 
I don't think clients would take the mick the same way as friends do, Terry, lol, but I'm not convinced that I'd like to find out. I'm far too much of a soft touch, far too often.

Lastolite, lol, that'd be just my luck. "And here, we present this glorious splodge calendar, with a hint of ghoul-like images of children, to brighten up the dullest day in your year..." dear me... lol
 
umm when I get stuck like this I always ask myself whether I would want it framed and on my wall

If I was the mother of the child in the pic then I would def. say yes to the unmolested one, but the 'arty' one? not a chance!

I would have blown my top tbh and made sure she knew exactly how I felt about my butchered images. It wouldn't bother me if she got offended as she obviously didn't care about offending me with her artistic interpretation of my images
 
That's what hubby said I should have done. I was reasonably diplomatic but felt guilty that my saying "no" upset her.

I said no, and the group think I'm being unreasonable not letting her use my pics for her design like that. *scratches head....very hard*

Honestly...groups exclusively full of women, I seriously find hard work...but that's another story lol
 
Tell the group to take their own snaps for the butcher to "artificate"!
