what would you do if someone steals your photos for the second time

I'm a bit annoyed because on of the drivers in one of the racing series I cover has used my shots again on his website. I already told him once before not to do it and he appologised.. i just checked his site and he's done it again!

i e-mailed him and told him i cant give away the photos for free and told him the only way he can have them is if he pays me to shoot for him for the rest of the season.
To be honest i wanted to write something angry, but i guess its not a good idea to make too many enemies in this tough business!

Its a nice compliment, and he did leave the watermark on, but at the same time its costing me a fortune in petrol to get to these events and i cant afford to do them for free.
 
hmmm, first off, your shots are excellent so i understand his attraction to them.

i would send him a bill, you gave him one warning, so he knows the problem, make sure you get some screen shots of them on his website. help back up your claim if it goes to court. dont back down till he pays.

or drive take a petrol can into his pit garage and help yourself to a tank ful of petrol the next time your there
 
Give him a good "filling in" at the next race.................:thumbs:
 
Seriously, if he has used your images, perhaps he should take you out for a few laps as recompense? If that is your thing.
 
oh yeah, stop taking pics of him would help as well if poss
 
i would suggest against posting if it will end up in court.

if you dropped a subtle hin and people picked up on it, then so be it
 
because it keeps specific details off the net, im no lawyer, but always cover your back first till someone qualified clears you. he may claim slander etc:shrug:
 
just to point out, i havve absolutely no idea on this, but i do remember people suggested to petemc to stop posting bout his court case for some reason or other
 
it wont end up in court, because its not a good idea to make such big waves in such a small pond..
My aim is to turn the bad situation into something good and maybe get a couple of new clients out of it... if that doesnt work i'll just tell him again to take them off the site.
 
I think the suggestion to just stop taking pics of him is a good one, or failing that, single them out for a huge watermark right across them!
 
in solid writing so thery are unusable if he doesnt pay

there is no copyright notice or details as to use and also the photos have not had the Iptc info filled in.

The watermark on you photos will not stop anyone, as it is too easy to crop off

Although you have resolved this one - it will happen again and again and again...your photos are good so people want them
 
First off, well done for getting this resolved to your advantage.

I am sure many here, my in particualr, would love to hear how you handled the situation and what exactly did you do. Especially since the matter is thorny for most pro., semi-pro & aspiring pro. photographers.

Again, well done for handling this in what seems like a mature manner (unless you've resorted to something we really don't want to know) ... just kidding :thumbs:
 
Not sure about the procedure, but I think you can issue a take down notice to the web hosting service. They are after all hosting pirated material. Losing the web site may well be an issue to the person stealing the pics.

thanks for the compliment.. Its a good idea too, but part of the agreement when getting accreditation is that you dont sell the photos.. Seems strange, though as most people seem to still do this.

There is nothing slanderous in this thread.
 
Congrats on getting a sticky situation resolved into one that brings in the pennies! I've never had that problem before thankfully as it is always a tricky situation.

I always thought that clause that you arnt supposed to sell the photos was a strange one too.
