So, were due to be married in June and as its looking that's not likely to go ahead, we have a separate Reception and Ceremony Venue.
The ceremony venue have said we should pencil in an alternative date with them just in-case and have offered us use of one of their alternative venues if for some other reason the other isn't available, couldn't be more helpful.

The problem is with the reception, we've asked if pencilling in a new date is possible should there still be a ban on weddings and gatherings, they've said yes but any date changes will incur a £40 charge.
We've also asked if a new date can't be agreed on and the wedding cant go ahead because of the ban, they've said the monies already paid are not refundable.

This doesn't seem right to me? If they cant host the wedding because of something out of our control then we should be entitled to a refund shouldn't we? And surely we should be expected to pay a fee to change a date if they cant honour the original?

Any advice would be appreciated?
 
I think they are being incredibly mean charging you £40 to change dates, it may be in the contract but these are exceptional times. As for no refunds, difficult as they will obviously not be able to fill the venue on the original date, albeit not your fault, but if that's what the contract says then that's what I guess is what it says. A lot of places that won't have their venues filled due to CV seem to be adopting a more generous stance, hoping people will rebook if shown a decent attitude.
Personally if the deposit wasn't large I'd forfeit and go elsewhere.

In regard to both venues, what exactly do the contracts say? As I wonder what it says about their inability to meet their side of the contract(s)??? How similar or not as the case may be are they on that aspect?

Their response and attitude does them no credit.,....if only on the basis that the issue is neither in your control or theirs and as an entertainment business "they" are the ones who have been told to shutdown.....do why penalise their customers!!!!
 
I am due to shoot a wedding on 23rd May and fully expecting to refund the couple the deposit paid - it is the right thing to do. I would certainly go public with this should the need arise.

We have a contract lawyer in the family so they are going to have a look over it and see where we stand.
 
I am having similar issues with a holiday cottage booking. They are not charging for rebooking but will not give a refund. The contract is very one-sided and they are keeping to it. I expect it could be challenged for non-performance.

When we get through this crisis, people will remember which companies etc took a decent attitude and those that didn’t.

I assume you do not have wedding insurance?

Have you seen the recent thread about "frustrated" contracts, maybe this applies in your case too.
 
Not directly related to this, but I have had no trouble getting a refund from Premier Inn, for cancelling a booking booked under their cheaper non flex option.

There is a thread in business at the moment which is relevant. I believe, legally its a frustrated contract, neither you, nor they can deliver because of changes in the law. So the contract is null and void. Of course you could tip off the tabloids. I bet they don't want the press

Been quite busy so sorry for being late getting back to everyone.

Its all sorted now, postponed till next April. Just had a bit of a panic when it first came about.

Good result although they should not hold on to your money for that long if you have paid in full. Hopefully not, but they may no longer be in business next year.
