Warranty on replaced lens

I have just returned a lens which developed a fault after 10 months,the manufacturers have agreed the fault and offered a replacement,which i have agreed to.

Can i expect to get a full warranty on the exchanged lens (dealt with through my LCS ) or should i ask my LCS for an on paper refund and repurchase.

I'm not sure if you can get a refund on your purchase after 10months ....... For the warranty on your replacement lens, I think you need to check with the manufacturers on that.
 
The warranty is part of your contract of purchase. No new purchase, no new contract, no new warranty.

Another way of looking at it is that the warranty effectively guarantees you 12 months use of the product, from the date of the purchase. If it fails, they replace it, and the warranty is still there giving you 12 months use from the date of purchase. If the replacement item were to fail after 2½ months (so 12½ months after the purchase) you might be able to claim that because of the hassle involved with the product failing and having to be replaced you haven't actually had 12 months of usage. But once you get to about 13 months from the original purchase I wouldn't expect that to work.

Don't forget the "warranty" is only part of your rights. Under the Consumer Rights Acts if can be argued that repair / replacement should be available on something like camera equipment for much longer than 12 months - however, as I understand it, if you've had (say) a camera body for 18 months; if its shutter breaks then if it has a shutter count of 20,000 you have more chance of a repair than if its done 90,000 (just as an example). In the OP's case of the lens, then the replacement would still have to be of "satisfactory quality" and "fit for purpose".

Like Stewart IANAL ... but http://www.which.co.uk/consumer-rights/regulation/consumer-rights-act gives a good overview of your rights under the 2015 act. Anything purchased prior to (I think) 1st October 2015 would be covered under the previous Sale of Good Acts. As a final note, under Consumer Rights Act your claim is against the retailer vs. the warranty which is an offer made (as I understand it) by the manufacturer.

The OP is getting a lens replacement from the manufacture. I think the situation is he bought a lens new from the shop and own the lens for 10months, now the lens had some faults and is within the 12month warranty period. The manufactory agree to replace a new lens for him.

The question is will his new replacement lens get another 12month warranty? I think the answer is no but it needs to be check with the manufactory to confimr this.

The second question is, can he return the lens to the place where he bought it and get a full refund? I don't think you can get a refund after owning the product for 10months? Again, need to ask the shop and see what they say.
 
Thanks for the replies,iwould not exprct a full refund thats why i said an on paper refund and repurchase.

I didnt want to sound unreasonable but the way i looked at it was,when i purchsed the lens it was a new model only been available for a couple of months so not proved its build quality and so its reliability,the offer of an replacement was very quick and easy this concerned me after 10 months as to what had they seen inside it to make them offer the solution so quickly.

Taking another £1400 lens possibly made with the same construction as my previous one and so possibly the same shortcomings with basicly a 2 month warranty is a worry,if the lens had been around for a couple of years with no problems i would have thought i just got a bad example.

After dealing with my LCS for 40 years i dont doubt his willingness to see me right and look after me i was just seeking opinions.

As you say it will be for the manufacturer to confirm. It partly depends (I would think) if the replacement is new or a reconditioned lens. Reconditioned items (in my experience) tend to have a 6 month warranty. The warranty is something offered by a manufacturer and is separate from any statutory rights.

I didnt want to say as i have had no problems with them and in fact they have been quick to resolve my issue, it was more a case of could i expect my warranty to be extended.

We are a bit unusual in the sense we keep reciepts for all purchases and do quiet often return items as faulty, we find that all shops inform us that if we keep the return paperwork the item will be covered for 12 months,i didnt know if this was just goodwill on the part of the shops or a normal thing.
 
Very unlikely the manufactory will extend the warranty. When you first bought the lens, you have 12months warranty cover. Within the 12month you can send it back to repair or replace free of charge if the fault is the lens itself (not human error). After 12months, you have to paid for repair etc.

Most manufactory gives you 6months service/repair warranty if you commission them to do the work.
 
10 month old lens you will only get 2 month with the replacement or you could have a pepetual warrranty think about it
take the new lens and sell it right away then buy a better quality build lens

Cant do that its m4/3 and no other lens covers the range i want.
 
Don't forget that the new item still has to be fit for purpose and of merchantable quality.

If the first example wasn't fit for purpose enough after 10 months why would a replacement that breaks in less time be deemed fit just because the total lifetime is now over 12 months

Unusual but not unknown. My 2nd hand X10 Fuji had had the orb issue dealt with under warranty and came back with a new 12 month warranty. JUST (2 days!) within the extended warranty period, it developed another, unrelated fault and they (Fuji) repaired it again and gave me another 12 month warranty period.

However, another manufacturer (one of the 4/3 gang) weren't interested when I had a problem a couple of weeks outside the 12 month warranty. CBA to chase the matter as a "not fit for purpose" option, just will never buy any of their products again and advise against anyone else doing so.

The reason i said that was when I had a lens repair from Nikon. They balls it up and messup completely, on return they fix it but did not offer anything extra except the standard 6month service warranty. Now I move to Fuji system.

Unfortunately ime not a Fuji user but they are building a reputation for customer focus.
