Hi

I did an equestrian event earlier on this year at a livery yard. I put the photos (copyrighted and image numbers on each photo) for display on my website.

I also put some of the pics on my facebook (still copyrighted and with the image numbers on) and tonight I find that one of the people (who didn't buy an image of HER horse), has lifted it and put it on her facebook. From the text she's put on her facebook, it sounds like she no longer owns that horse.

What's the next step, I don't have this persons address and I'm not even sure she's still at that livery yard. if I make enquiries, then it'll tip off the yard owner who might tip the girl off.

Suggestions please.

Thanks
Lisa

Does the pic on her facebook still have your copyright and image no.? If she has removed it then that should tell you that she knew exactly what she was doing. If not, maybe she thought that since it was her/her horse in the pic, it was ok to 'borrow' it.

Can you not contact Facebook? Surely they would remove it.

i second that, as she is breaking one of facebooks major policies by using a copyrighted photo

shame the person wouldnt just pay for the photo, if only it was that easy

if you are looking for payment, take a screen shot of the image on her facebook and print it.

send her a message and request payment.

if you want her to remove it, try sending her a message?

also check if she is tagged in the copy you uploaded on your FB, if she is then se may just be displaying that pic, if she is un-tagg her.

Sorry to say that if youlook through the young riders pics on fb, you will find hundreds of thier horse pics, with the copyright plastered all over them, you & I know its wrong, but how many 11 to 15 year olds do you know that give a toss about it :rules::shrug:

Hi

Thanks for the reply.

I've found someone else too who has lifted four of my images from the same event.

All of the photos have big copyright and img numbers on them.

These people arn't children, they're adults.

I am going to try and get some recompence for this. It's not on. You find this problem with 'dog' and 'horse' people, they just don't like to pay.

It's gonna make it a bit awkward because the livery yard owner is a friend of mine and I did some free shots of her and her horses for the 'gig'.

Thank you. Would you charge the going rate for the shots I previously quoted or would you add extra?

I'm not sure if I can send a msg as she's not on facebook as one of my friends, but I managed to view her photos. I'll try it though.

Write, preferably, if you have their addresses, using the term "Breach of Copyright". Try to get their addresses. Would the livery yard know? It would show that you're serious.

TELL them to remove the images.

My guess is that you'd be lucky to get any payment.

Thanks. I can pm the two people. I'm going to send them an invoice attached to the pm.

Yes, I believe I can get their addresses.

Thanks

In this situation I would invoice for double the normal fee as it's unauthorised use. Easier to get the money from a corporate than an individual though sometimes - you need to get their address as a first step. Good luck!

Personally, I would just report the photo to Facebook. That's what the option is there for.

I must have dozens of photos used improperly on Facebook, including ones were my logo has been removed. He-ho. I'm not gonna start billing people for it.

Thanks for the replies. Sorry, but as a woman of principle, I can't let this drop. I've just typed up the invoices.

Lisa

there are thousands of mine on facebook... my address accross the middle does OK for me... however some people take the mickey and put hundreds on there page... I tell them to remove and if they dont then facebook have in the past removed them the same day..

i wouldnt even waste my time asking any of these people for money...

to be honest im not even going to look for any of mine on facebook, if anything the only ones theyll be are the low res watermarked versions and least its a bit of free advertising lol

I think Kipax has offered the best solution.

What if she had tagged herself in the image on your page? It would still have been on her facebook...

It has your copyright and address on it, I'd be tempted to treat it as free advertising.

Although annoying, if you upload lores images you pretty much have to accept that individuals will post them on their personal fb accounts.

This is a minor infringement... if you slap an invoice on them then you're one step to getting a bad name as being pedantic (regardless of if you're correct). I would just ask them to take them off or buy the images if I where you. Or just point out to them that they should not be using your images without asking / paying.
Use your efforts on more important breaches.

I'm largely in agreement with this.

It's a waste of time and energy pursuing this type of thing. It's also a small world and you'll get known very quickly as the bullying photographer, no sales and a bad name.

Hi

I've just checked things. I never put the images on my facebook, they were on my website, that's where they've got them from.

I've reported this to Facebook.

To be honest, I'm not really bothered what the horse fraternity think of me. Some of them would sell their own child if the price was right. LOL!

Anyway, after thinking about it, I'm not going to persue things any further.

You will always get this and far too difficult and time consuming to police the net looking for your proofs !! At that size (for FB) she is unlikely to get it printed, so if your copyright logo shows your website address, think of it more as advertising !!

IMHO, if you are in the business of photographing equine events and riders, then you should make it your business to be bothered what they think of you !! :cuckoo:

Actually, I'm not in the business of photographing equestrian events, it was a favour for a friend who owns a yard. :cuckoo:

Having had horses myself since the age of three, I know exactly what 'horse' people are like. If anyone would like some tales, then feel free to pm me. :):)

Sorry, from the text in bold it seemed as though you meant she had taken it from your fb.

My original comment still stands though.

To be honest it is not worth the time it would take to do anything about it. I would just forget it. Had she been using it commercially then that would have been a different matter.

Thank you. I thought she'd taken it from my FB but she and someone else took them from my website - which incedentially was only created as it was a prize in a competition which one of my dogs won.

I'm just a hobbiest (sp). I don't market or promote myself. I'm not interested in finding paid photography jobs or anything like that. I used to do pics for free which included printing and posting them off, it was experience for me and I hoped the recipients liked the photos.

At the end of the day, I was asked to attend this event by a close friend of mine. People bought pics and some didn't, that's fine.

What I do object to however, is if someone can afford to pay £140 per week for livery, drive a 4x4 and tow a brand new trailer, then surely, they can afford £8 for a 10x8 photo printed.:)

Anyway, that's all there is to it.
