Unusual Black Spots

Good evening. I am experiencing some random soft black spots on my photos. They do not show up on all of the photos, just the odd few. However, when lights (in my case car headlights) are pointing towards the camera they seem to be apparent. I have had fainter spots on a few other pictures where no headlights are involved.

The equipment in question is a Canon 7D, Canon 70 200 F4L USM which has a Hoya Pro 1 Digital Filter attached.

I have attached a few unedited pictures as examples... Any ideas?





 
Dust spots (on your sensor)
You tend to notice them against the sky, or light objects. (they also tend to show more as you close down your aperture)

Question:
I thought dust spots on the sensor would appear on all photos?

I have pictures at the same spot and they are clean - at the same apertures (F4 in this case).

Not always no, firstly you'll see them more at the extremely small apertures f/16+, but secondly also they can get moved around by the vibration of the camera self cleaning and also vibration of using the camera
 
I have taken a picture at F22 and it appears to be clean.

I have cleaned off the rear element on the outside with a lens-pen and there appears to be dust particles on the other side of the rear element. Would this cause these random spots?
