Trespassing - I want to ban someone from my property...

Right.. Long story short, parcel delivery company managed to rip my garage door off it's tracks, denied it, then admitted it later on. I've paid out for the repair to my property. Since there seem to be so many inconsistencies in their story (and I have another address they can deliver to ;)) I'm going to ban them from my property.

MY question is... Once they're banned, if they do decide to enter my property (and I will know..) what can I do about it. The trespassing laws in the UK are quite relaxed, so the question is, can I actually do anything about it if they decide to ignore me?

Seems like a waste of time tbh mate, and will just create more hastle for you. I'd get them to pay for the door. That'll leave a longer lasting message tbh.
 
its a civil matter mate, not much you can do really unless they start breaking in or something.

I think you do have some rights down your way to prevent someone from tresspassing on your property, up here in Scotland the property owner has very few rights to prevent access, in fact we were fairly lucky in that the neighbours across the back had been using our garden as a shortcut for about 15 years before the family moved, if it had been over 20 years it could be argued that it was now a public right of way :bonk:

They did, but they also reckon that their driver injured his leg in the process.. which means they'd just counter claim and it'd end up nowhere.

Looks like I'm on a hiding to nothing by the sounds of it :(
 
He'd have to prove he did it on your garage door and that you were in some way negligent (like in not having a 6ft neon sign saying warning, garage door!), whereas you have their admission of guilt already!
 
Why don't you just not give that address as a delivery address any more and then they won't have the need to be there?

Or am I missing something?:thinking:

You'd be amazed what people can get away with claiming for. We were advised (by the Police) against putting razor wire or broken glass (my choice :lol:) on top of our yard wall in case someone hurt themselves whilst breaking in, as they would be within their rights to sue us for the injury caused.

Gotta love the Human Rights Act :shake:
 
Broken glass on top of a wall has one purpose, to cause injury to anyone daft enough to climb over it, the same can't be said for a garage door.

It could be argued that if the door was in a "dangerous state" then leaving it thus amounts to negligence, which pretty much amounts to the same thing....
 
Which is what the guy would have to 'prove' which takes us back to my original point :)

Again the post has drifted and not helping the OP out.

Before this goes on too long, can you say how the delivery man ripped the door off as this is something that is puzzling me? If he ripped it off then injured himself how can he countersue? He can only claim off his own/work insurers.

Being brief is OK but you may need to give more details so that members can give a more defined response.
 
If you find someone on your land, you can take them to court (outside Scotland) and sue them for trespass......however it will be long and expensive, you might lose and have to pay their costs. However, people have the right to cross your land to come to your door to see you, and then to leave again. I don't think you have a leg to stand on, sorry.

True, but they should leave it as it was before they entered your property, if they cause damage then it can become a criminal offence iirc, someone will correct me soon.
 
Yes, but there are two points here: trespass and criminal damage. I'm just talking about the trespass.
 
can you explain why the delivery company would want to come onto your land if they were not delivering to you (you don't give this address to the supplier).

And if they do come onto your land then block their exit with a vehicle or three until they have paid compensation for the door ;)
 
It seems to me that you're the "Guilty" victim. What ever you do you'll be wrong or it will cost.

But Hey Don't get mad get even!! Next time they call while they are making the delivery go rip the door off the delivery truck!! NO DON'T but wouldn't it be nice?

What are you going to suen them for? Unless they've cuased damage there's no point. In this case the damage they've caused they're going to pay for.

AFAIA the only way to prevent someone form having access to your land is to take out a court injunction, a costly proscess for what little benefit you'll get from it.
