What is interesting is this person seems to be trawling Flickr they have no photos of there own but have commented on almost every photo in their favourites with a similar request from the few I looked at out of the 200 plus photos if I'm honest I'd be tempted to report the activity to Flickr as I'm sure there used to actually be a bit in terms about not permitting commercial activity that I'm sure this goes against

Good point - I've reported her activity as suspicious, but doubt they will do anything....
 
That's one of the reasons I've closed my flickr account. I lost count of the number of requests I had for free photos and the attitude that I should be grateful because my picture will be appearing in a publication or CD cover that someone else is getting paid for..." we can't pay but we'll give you an acknowledgement." Whoop de doo!

I also had a local restaurant use some images from flickr and the owner was confused as to why I was annoyed. "They're only pictures. You should take it as a compliment." That's a bit like a burglar telling someone it's a compliment to have their house burgled. The owner wasn't so cocky when he got a solicitor's letter demanding payment :)

I'm very glad you stood up to them - thousands wouldn't, unfortunately. I've had no end of chancers expecting to use my pictures for free, commercially and on book covers etc. Without exception they have been either dismissive or blatantly rude when the matter of payment was raised. There's nothing flattering about being the only person in the food chain who isn't being compensated.

I was really tempted to invite a few mates to the restaurant, order the most expensive stuff on the menu and when it came to paying the bill, show the owner the press ad and the menus using my photos and say "You didn't pay for my work, why should I pay for yours?."

But a solicitor who owed me a favour sent him a very stern letter pointing out that he really didn't have a leg to stand on as all my photos on flickr had captions saying they weren't to be used without permission and that the watermark with my copyright logo had been cropped out. And besides, getting something free from a solicitor was too good a chance to turn down! :)
