Statement

Out of interest ok, the attack thread..

well my friend was there so she was involved well not involved she just like tryed to get the girl off me etc.

So she has to do a statement but.. I always thought when you do a statement (if its serious) and well I wouldnt say its that serious but the girl did get arrested i was told :eek:) that you had to go to court?

And well my friend said i'm not going to court btw.

So yeah i'm kind of confused. Also mega confused on how that girl got arrested i mean I honestly didnt think it was going to be that serious. I thought they would of went to her house to get her side of the story kind of thing.

you can be arrested if you do not turn up at court ie refuse as soon as you sign the statement it is basically a legal document to say you have to go

i worked the doors for 5 years and sometime i couldnt make it they will send a police car out to get you and arrest you

and as for the statement it is to cover you and them so all info goes down on paper at the earliest oppotunity as some things can be forgotten

they dont have to ask or tell you as soon as you sign you are going to court Full stop

i learnt that myself there is no way round she will get a criminal record if she doesnt turn up and they will put a warrant fro her arrest out
 
Your friend would only be asked to testify in court under a particular set of conditions:

Police and CPS need to think that there is sufficient evidence to get a conviction and that it would be in the public interest to prosecute.

The attacker would have to plead not guilty - requiring a trial to establish guilt.

A statement is just that, a statement of what happened. The police can give cautions/warnings etc. and arrest people without it having to go to court or trial.

Just because the attacker has been arrested does not mean that it will go to court and trial.

As any fule no, cake wil be served to the attacker before she is sent to barbados for sesnitivity training and removal of that strange orange fake tan. ;-)

If it does go to trial and a witness refuses to give evidence then I think the judge can hold them in contempt of court.
 
dont worry frankee i read ** two threads and i forgive ya ;) and by orange she meant the orange permatan girls that look foul now that most girls look like that :)

But my point is.. she wasnt asked to go to court that early i dont think. But i know the police put a letter through her door for her mum. And i know her mum hasnt been in for the past 2-3 days soo ashley has....

It's sorted now anyways its in the past but THERES NO WAY ME and Ashers are two pea in a pod's i dont sit and take the friggan mick outta you lot like he does!!!

I have been in this situation before.

Basically long story short: I look at a drugged up to the high heavens on god knows what guy in town because he was throwing grapes at me. He says what you looking at ... blah blah you get the picture on that bit. cycling home he follows me. (I was walking down some steps at the time) I end up running down them he hits me round thre face before I could cycle away, and everyone in the area saw him (luckily I had a few shops that saw it happen too so I was quite good with witnessess (sp?) I have to make a statement, and have been told if charges are made (which I did want happening) I have to go to court and give my statement. He gets arrested (I dunno how they found his house) but he got arrested, and gets a warning. (If he hits/threatens me or anyone in town he gets arrested.

So unless they tell you your having to go to court you dont need to be worried.
