Sick Pay???

I wonder if anyone can help me here?

The other night on his way home on his motorbike my 19 year old son had an unfortunate accident where a stone from the car in front hit him in the eye. He had his visor up as it was cold out and the visor was misty (he knows that was wrong!)

He went straight to hospital at 1am and was seen and sent home, being told to go back the next day at 5pm.

He did this and they said it is improving (the whole eye is full of blood with an abrasion on the front and watering but he CAN see)

Then they wanted to see him at 5pm the following day too, where it had improved a bit more.

The last visit they said it is going to be fine but to take it easy and do nothing for the next 3 days and it will be fine!

He has taken these last 3 days off work (Krispy Kreme Doughnuts at Stansted Airport) and the next 3 that he has to have off too, as his holiday!

Surely he is allowed time off for something like this when a doctor has told him not to work........unfortunately he has no certificate as it has been 3 different hospital doctors not his GP.

So he has either lost a week's holiday or a week's pay. :(

He is too shy to ask anybody so Im doing it for him!!! :D

All depends on his terms and conditions.
How long has he been working for them?
Some companies do not pay sick pay if you have not been there long.
 
Send to his GP, get a proper cert, GP should be able to get confirmation from hospitals not to mention the fact that it sounds like its fairly bloody obvious what kind of injury he has.



EDIT: Yes, as above, although generally, if he is entitled to holiday pay, he is probably also entitled to sick leave under his contract and normal employment law.
 
The chances are that he is entitled to something. But he won't get anything without the GPs certificate so that is his starting point.
 
As fabs said, you can self certify for the first week, but it does depend on T&C as to what he is actually entitled to, specially if he hasnt been there long ! Best thing to do is have a look through his contract and see what it says under sickness pay, as a starting point.
 
You dont need a GP's cert for 7 days sickness, but companys dont need to cover the first 1-3 days sickness either, although some do pay striaght way, or after 2days etc. I personally get sick pay from day one, but you need to check his contract on that one. But you will need to fill in a self cert at work to cover the 3days off, if he needs more then 3 days then the GP will write one, and any holiday he was taking at the time the cert covers he will be normally be entiled to claim back.

I work in the building trade and it has always been the case that the first 3 days you need no cert but you donot get paid either after that you need a cert then you get paid, but somtimes depending on company it will be at a reduced rate from normal salary or nothing in which case it will come from statuary sick pay.

I say go see your doctor and ask him for a cert and get things cleared up, but like said previous you/he needs to check his contract.

On the bike/ helemt side of things tell him to go to local bike shop and buy some anti fog for his visor, I got some for mine and its briliant stuff, get a nose protector for the helemt too which will help misting. failing that have it open only to the first notch, that way thewre is only a small gap at the bottom but the rest is covered.

Thought he'd only been off 3 days and needed 3 days more.

yes i think he needs 3 more days .. we will see tomorrow if they say any more and i will get him to ask them for a certificate starting from the 4th day if that is correct.

PS thanks for the info, Spike, I know what will be in his stocking this year, and the first notch is a good tip too! ;)

You can sign yourself of for 7 days.

This will cancel his holiday and he can use that later on.

If he earn more than £96 per week he is entitled to statatory sick pay [as long as he has worked earning this for the 8 previous weeks]

Statatory sick pay is about £76 per week, his employer will have to sort this out.

Good luck it should be fine as it is the law.

Better than anti fog spray, get a Foggy Face mask Linky Not only do they keep the visor from misting up but also cut down on noise & keeps you a little warmer too :)
I used to use one before I got my present Arai which comes with a pin lock visor insert as standard (basically double glazing).
 
Get a sick note from the doctors as soon as possible to stop any delays in any payment ans as far as I am aware he WILL be paid about £62 if he is single and living with parents, this is the law as the employer doesnt pay but the government.....its what he pays NI for.

I didnt mean he had to be living with parents, its just a figure if he is entitled and it will rise if he has a family, like you say he is entitled to it provided his NI has been paid as for the amount ......up to the people in charge:thumbs:

yup always get get get that cert. even if you think youll be back before your stated time in your contract get it anyway.

when i erm, fell into a canal boat, and hematoma'd the hell out of my leg it was one of the first things i asked the casualty doc for lol

but i feel your sons pain, i grazed my eyeball with a sealant gun a while back and its not fun. the ointments actually worse than the injury lol

I have bought him one of these for christmas now RVF, and a can of Muc Off anti-fog spray just in case!!! :)
