i.e. credit in your bank account - the only credit worth anything!
 
Some good news! I got an email from the assistant editor of the mag. She said that her boss is away until Monday and when she returns she will be contacting me to sort out the problem.

I'll bet she'll promise that the cheque's in the post and that she won't **..... [self edit!]

Probably because doing that would reveal the name of the celeb and someone will say the name here. As she has already said she doesn't want to say the name due to an agent who has too much time to google his client(s) rather than find them work ....

My guess anyway :)

Yes, it would be interesting to know why he thinks I'm wasting my time - and everyone elses - making up stories on this forum!

Today I got an email from the photo editor of the magazine. She apologised for the mistake and offered me an interview on their mag website! I wrote back to her and explained that I don't want to be interviewed but I'd like my photo credited to me. I also said that I really think they should pay me something. So now I'll just have to wait and see what happens next....
 
That sounds rather weak - at best now they'll offer you a small nominal sum. Much better to have sent them an invoice for a realistic amount.

I think it's weak too! But I have mentioned money to them so now we'll see what happens. For me the most important thing was to be given credit for the photo I took.
 
Just got another email from the magazine. They've now passed my message on to someone else. They said maybe he'll contact me tomorrow. I get a strong feeling that I'm not going to get any joy from them. :-(
 
SEND AN INVOICE!! They can't ignore that. Base it on the alamy scale or the NUJ scale but from what you've said it should be a lot x 2 for unauthorised use. If you act like an amateur they'll treat you like one.
 
Please listen to, and take, the advice of Andrew (AWP).
If you just phone or email saying 'hello anyone there id like a reply' they will ignore you.
Send an invoice, If no reply to that send a Final demand invoice. Failing that meet them in small claims court.

You have to appear to be a professional for you to be treated like one, otherwise they will walk all over you. In your eyes it might be that you only want the credit line, but at this stage it is best to pursue payment for your image + unauthorised usage and maybe even add the cost of having to chase them up, phone calls, time spent writing emails, buying the magazine to confirm the image etc.
 
I take on board what you are saying. But first of all, I am not a professional photographer, secondly the photo editor of the magazine has contacted me so they're not ignoring me. It's a french magazine so I don't think the small claims court would be much of a help, and I really can't afford to go to an expert lawyer because he'd probably charge me more than the photograph is worth! If professional photographers have these kinds of problems to deal with all the time I really feel sorry for them!
 
OK, if I don't get any joy from them I'll send them an invoice but they could still decide not to pay me, couldn't they? And the fact that they offered to interview me on their website shows that they're just trying to fob me off!

Professional photographers have more problems like this every time an amateur allows their pictures to be used for free - or for a credit only!

You're quite right, but there's a limit to what I am able to do about this.

I think from reading the forums it's what your willing or confident in doing and not what you are able to do!

They have used your image and as such you are entitled to payment...
 
Yes, but if they don't pay me there isn't really much I can do about it. If they were in the UK it might be easier for me to do something but since it's a french magazine it's a little bit harder to force them to pay. I'll know more tomorrow when they contact me again.
 
Im not a pro - but even i wont even let people i know have free pictures anymore (as of the other day) when i realised i was ripping myself off!

if people dont like my work - they dont buyt it - it really is as simple as that - so! if people are using your picture - charge them!!!!! :lol:
 
In my case I didn't even know that a magazine was using the image. It's a foreign magazine who didn't even give me a photo credit. They probably won't pay me either So what would you do? Go all the way to Paris to complain, or pay some lawyer a huge amount of money- maybe more than the photo was worth? It's never easy to get money out of people here in the UK, so I guess it'll be pretty hard to get it from someone living in another country.
