Should I tell them they sent me the wrong lens.....???

Call me boring, but I'd let them know straight away what they had done and send it back to them (at their expense of course).

Honesty does pay IMHO, even if it's only reward is a good night's sleep.

100% 'What he said' and you may well get 'whatever flexibility is going' for future purchases with this seller.:thumbs:

Is this true? If I receive unsolicited mail (as in this case as the lens in question was never requested) it is my property so why would someone sending a parcel be different?

Unsolicited Goods and Services Act 1971 surely would come into effect? meaning they have 6 months to contact you and ask for it back, after that its yours

(This is talking just legally of course, no morality)

I'm quite certain. This isn't unsolicited goods - it's goods sent by mistake in place of something else you ordered. Knowing this, when you make the decision to keep it you dishonestly appropriate it (steal it) for the purposes of the Theft Act, 1968.

I'd notify the vendor in writing by recorded delivery. It' s up to them to arrange recovery of the goods, but if you don't do that and the wheel comes off, you'd have a lot of difficulty explaining your position. It's really not worth the risk.

Now there's an idea! :lol:

All the angles are well covered under the law - when you knowingly come into possession of goods by a mistake on the part of the owner and you keep them - you're fubar'd. ;)

These things do have a habit of coming to the surface too - during audits and stock checks.
 
I notice here that the majority of posters are keeping to the moral high ground..why is that? Does it make them feel better? I have been lied to (even white fluffy lies) by most,if not all, the retailers I have ever had a dispute with , the fact is that how ever good it makes people feel to post "good honest" advice here at one time of another they have had a WKD moment (too much change or somesuch event) and been dishonest.
If people here can honestly say they have never took advantage of such an event then I would suggest they are lying or aliens.

A fair point. While the law is black and white, there is a practical grey area for most people.

If you liken it to theft by finding- finding property and keeping it, then the law says that you have to believe at the time of finding it and shoving it in your sky rocket, that the owner could not be traced by taking 'reasonable steps' Now those reasonable steps would usually be to take it to the cop shop or hand it in at the premises where you found it.

So is it likely that you'd trace the owner of a £1 coin . Of course not! Even a fiver or a tenner would be most unlikely, I can't see many people reporting the loss.

Make that a bag with a couple of grand in it though, and however much we might like the answer to be to our benefit, it isn't going to be. ;)

Whilst I don't suggest the OP keeps the lens, I think most people who have said the same thing will have, at some point, done something that is frowned upon with the eyes of the law - we just don't like to admit it openly :)

(It's amazing how many people online have the latest version of Photoshop within days of release - and sometimes before...lol)
 
I remember a geezer many years ago reporting the loss of his Christmas pay packet with all his bonuses in it, in the town centre. He was actually in tears as he hadn't even bought the kids Christmas presents at that stage and he was a working stiff not exactly overwhelmed with money. I had to tell him in all honesty that the likelihood of it being found and handed in was most unlikely.

Ten minutes after he'd gone, an old couple handed the pay packet in! They just said " Well it wasn't ours was it?" It does restore your faith somewhat.

100% true and if you check a receipt and youv'e been overcharged you will go to great lengths to point out the mistake but if you find you have not been charged for an item do you find someone and ask for it to be included and cough up the money?? Only if you are completely bonkers!!!
The point is , as someone pointed out, the amount of money involved.....like The Icelandic bank or northern rock...now even I couldn't do that :shrug:

lol, I've tried to contact them and let them know but they were'nt available over the weekend. However I have now received an email from them wondering if they have made a mistake! :)

I'll be speaking with them today regarding getting it back to them.

Various people have touched on the moral aspect of this and some have mentioned a grey area. For those that don't believe that a 'faceless' crime exists then stop reading this post now, otherwise...

Say Tesco's said they were going to give you a £20 credit into your bank account for some reason, but when you checked your account you noticed they had given you £220. What would you do? I fully admit that in that scenario I might keep stum. What about you?

Now say that Tesco's sent you a lens (if they sold them) that was worth £200 more than the one you asked/paid for. Is that different to above???

I'm not saying I would definitely act either way in those scenarios, however in my mind there is a difference between cheating a small company/person or 'sticking to the man' aganist a company that makes billions of profit each year. Naturally, I doubt such a distinction exists in law.

Just some random thoughts.......
 
personally i would kick up merry hell that you missed a shoot because they sent you the wrong lens andwas no good to you and you would like something back for the hassle:thumbs:
 
kalibre - why not try complaining to the company and ask for compensation because they sent you the wrong lens and you missed a shoot.

Point no.2 is tell them you are a very honest person, but you could have kept quiet and kept the wrong and more expensive lens they sent you.
 
Why lie about the situation, we all make mistakes, just hope that the next time you make one you hope that someone will do the right thing....whatever that may be.
 
Well, as it is they are also now saying that the stock they ordered from Tamron for the 17-50 didn't materialise and I may not get it before xmas now. I told them that my finger is on the big 'Warehouse Express' button ready to order as they have stock. They are getting back to me.

So as it stands, no 17-50 and a 150-500 instead of the 50-150. Have got a shoot next weekend so I may actually miss it! (Or shoot the whole thing with the nifty lol.)

Lol, no it's Devon Cameras (devoncamera.co.uk). In their defense they are generally very helpful and very well priced.
 
AJ Purdy gone under?? I dont know, It would not surprise me if they had though.
