Selling Photos as Postcards

Hi There,

I have taken a few photos of a couple of places in Scotland. I have a contact (who works for a local information centre) is interested in putting some of my photos as Photocards for sale (with the information centre taking a cut).

I have only found out about this tonight. You can find some of the photos on my website www.dan-taylor.co.uk and click "Gallery".

Anyway, the reason I am posting this here is because they would like to see some samples etc.... Some of the photos have a light house in it, or a boat (with part of the Reg number showing). Do I need to get permission for all these before I can turn them into postcards?

If you were on public land at the time you took the photo, then strictly no you don't need permission! However it may be polite to ask anyway, chances are they will say yes if you give them a print or something in return! Could you possibly photoshop the reg out if not??

Yes, I can photoshop the reg out. But I'm also talking of things like the Lighthouse.

There is one of "Castle Kennedy Gardens" and the Castle. I think they are some Cousin to the Queen, I would assume I could not produce a postcard of that seeing as even though it has "public footpaths" it's still someone's house, and you have to pay to the enter grounds!

But for the churches/lighthouse/beaches etc, I should be okay?
 
The law as I understand it is...
If you are stood on public land at the time of taking the shot then no permission is needed.
If you are stood on private land then you need release contract's for buildings etc...

The only problem is when it comes to commercial use for the images.

Thanks for the replies everyone, for the majority of the shots I was definitely on public land such as beaches etc.

I am using the old BlackBerry to view the forums so can't click the links right now... But will definitely check this out in further detail this evening!
