Secondhand Trading Advice

As I understand it, the OP agreed to buy the 450D for £290 and the lens for £300.
He then paid for this with £360 'cash' and £230 in 'Trade in' of the G9.

The person selling the 450D + Lens has now decided he is not happy with the deal, and is claiming the condition of the G9 as the reason.

Since the deal was based on a particlar value of the G9, then the offer by the OP to 'buy back' the G9 for £230 (the agreed 'trade-in') AND pay the relevant postage seems fair, turning the original deal into a cash transaction.

Yes then the OP has a G9 with a scratched lens now the other person has used it, so why should he offer anything, still a done deal as far as i'm concerned, as i see it there's no going back from this, end of story.

The other party reported the scratched lens on receipt of the g9 camera though - or thats how I understand it. Its the OP who has scratched the 450.

This sounds like the best solution, I would certainly not buy the guy another G9 and send it to him. I would ask that he send the G9 back and when I get the tracking number I would Paypal the cash over.

I think you've been more than generous with your solutions to the situation, and if he doesn't like it, then it's tough. You can't agree a deal and then decide you don't want it. He will have enough money to replace the G9 and some spare cash.

You've basically offered him almost £600 in cash for the set, which I'd say is reasonable. As it is basically the cash value of the deal he agreed!

Your well within your rights to tell him to prove the scratch was there before he bought it (assuming you believe it wasn't). Has he shown you any pics of the scratch, or images where it is visable.

We all know there are risks when buying secondhand!

Its the OP who has scratched the 450.

That needs to be proven, which is virtually impossible.

Quite right, and should have been done immediately, like has been said there is always risk in buying second hand, fortunately that is one of the reason's we have a feedback system on here

The OP admitted themselves that they scratched the 450

Yes sorry what i meant was the scratch on the lens of the G9, if the OP scratched the 450 he was fully entitled to, as by that time it was his camera.

Just to save any confusion (or me sullying my name with a "tough luck" attitude).

I was saying that honesty is the best policy, but GeForce Junky has tried to solve the situation in the fairest way possible and the buyer sounds like he just wants to pull out now.

If was the other party, then (even if I thought I'd actually agreed to a slightly unfair deal for me) I would accept the cash offered, or a compensation as it is fair and reasonable gesture.

Buying secondhand (especially on TP) has for me been a great experience. You get kit otherwise out of reach for a fair price, and I have always found the kit has been well looked after by fellow photographers. Unlike experiences on "ahem" auction site, where it's a lottery!

Hi Stew1982,

I agree with you and prefer to buy from this site rather than said auction site. Often tell people that 2nd hand is a lottery but if you buy from somewhere like TP at least it is the other persons reputation that is at stake.

Regards

Chris

Sounds to me that you are more interested in any potential legal implications as morally you don't care otherwise this thread would not have appeared (absolutely no judgement being made here, just an observation)? Its a private sale, you are not a trader and I would suspect that the scratch wouldn't be enough to say the item was misdescribed. He could take you to small claims court if he felt the need but 1) shaky ground 2) loss of earnings/holiday to turn up and travel costs.

Morally its upto you really but then again thats not the purpose of this thread is it?

:) I have kinda solved the situation.

I told the guy I was in the process of aquiring another 'Mint' G9 for him to have as a replacement and he suddenly decided he would take the cash sum and return the camera after all!

The only problem now is I am £240 out of pocket and still have a G9, which might not be worth what I thought it was :'(

:clap::clap: Cheers for the help guys, Its been really useful hearing other peoples POVs. TP rules :D

The scratch may not be as bad as you think.
You will have to be honest though when you try and sell it on.
