If they take your money they have to give you the goods!

As far as I'm aware from many many years ago if a product is priced incorrectly then the retailer must either sell it to you at the price advertised or not sell it to you at all - they can't demand a different price from that advertised. Therefore, if they have taken the money then that forms the contract and they must deliver accordingly.

Not sure if rules have changed or if terms & conditions may give them a get-out option but I'd be surprised if any terms & conditions could override law - if the law is still the same that is. As mentioned by someone it would be false advertising and they'd probably be better off cutting their losses by honouring the advertised price rather than an investigation and potential fine! lol

I bet the website designer has had his trouser snake put through the sausage machine though.

It is only when they take the funds that it is assumed the order has been agreed, up until that point it is only an invitation to purchase and there is no obligation on the seller to sell to you at any price

I still don't reckon that anyone is going to get one at £12.29.

I imagine they won't have any stock, and thus will be able to invoke the cancellation T&C's on their site.

What site was that from Ju ? ive only recieved a confirmation email saying its expected on the 19th.
 
I mailed them yesterday afternoon to check the status and that was the reply I got. It was from Choice Stationary.

Actually legally this is a Grey area.

I could argue a very convincing case that they don't.

If they have taken payment, they have agreed to your 'offer' and entered a contract, it's as good as a signature, it's no longer an 'offer of goods', they have accepted the payment for said goods, and i'd also argue this case.
 
Its a Grey area. A contract requires a "meeting of minds", and I'd argue in Court
that as payment was accepted automatically and electronically, no such "meeting of minds" occurred.

Off course, you could spend hundreds of pounds going to Court to try to win this one, but its only a £12.29 thing and clearly mis-priced.
 
All down to the T&C of the site. I have ordered probably twenty misprices over the years and only ever got a Gamecube for 35 quid from tesco a few years back when they were retailing much higher than that. All others have been voided and refunded with an extract from their terms and conditions. Worth having a look at MSE for extracts of people saying stuff like 'I'll take them to court if I don't get my pound of sprouts for 1.3 pence.' Total waste of time but you have to be in it to win it and some may get lucky.
 
Just spoke to my brother in law, who is in retail management. He reckons that if they take your money, they have to provide the goods............

hmmm, i've just had a paypal refund of £12.29 from them, no email though. Think i'll be giving them a ring tomorrow, hopefully give some grief ;)
