hi all just to let you know the latest on the camera i payed for and havent received i have contaced WHITTIE with no reply yet and i have tried to contact jamie (J4M13) on a number of ocassions via texts and phone calls he will not reply back to any of them i still not received the item he left a message saying that he had posted it via his works but he was waiting on a tracking number this is a load of rubbish as you get a tracking number straight away i have also been in touch with his works and they said that he hasnt worked for them for a while also i have now been in touch with the police and i am waiting to see what they can do about it i am aware that this person has other items for sale on other sites so please be aware as he could be advertising goods that he is clearly not going to send out i will keep you all updated when i hear from the police. shell

I thought you had made contact from the report he made in the other thread? Is that not right?

Hate to say, but I dont think the police will be interested.

You paid via paypal gift, thats akin to handing a stranger a wad of notes.

As per forum guidelines you should aslo have this guys name, address and phone number before sending any money.

I hope it works out for you, but I wouldnt hold out too much hope.

Well your wrong there, we reported a fraud to the police, taking monies without the goods being available, paid by paypal. Paypal weren't interested but the police were and had 2 police forces involved.

If you paid your paypal account with a credit card, would you not be covered by the card company for any loss?

As BT says we had Nortumbria police and Humberside police on the go, two officers went to the guys premises but he had done a flit, but they kept on the case and eventually found him and prosecuted, one week later everyone he tried to con had a special delivery from him.

So its worth involving the police IMHO

Well, you must have a good force then. In my experience they told me tough luck.

the police says i depends if they find it has been a con then they can do something about it if not then it legal action from me they have found this to be a con so now they are trying to find out where he lives i have bought things in the pasat from tp and have had no probs what so ever but imho i think whittie and j4m13 are in this together

It probably depends on how many people they have ripped off, if in this case it might be the same as you BUT if like dangermouse where it sounded like alot of people had made claims they would have investigated more.

To Shell I really hope this sorts its self out for you, It depends on how this has been posted too as to the time it will take to reach you.

Should you really be discussing this on a public forum? You've contacted the police, leave them to investigate and reach some form of conclusion before publicly badmouthing the two parties involved.

i dont want to bad mouth both parties but both parties will not reply so what does that say? the last time i heard from j4m13 was when he posted it was posted through his works and that he was waiting for a tracking number but like i have already mentioned you get a tracking number straight away also he hasnt worked for the garage in a year so what is going on is it a scam yes i do think i have been scammed i donot like to bad mouth people but i need this brought to everyones attention in case they post with items for sale again i donot want to see anyone else scammed

Shell,

1:you didn't follow any forum rules

2: using Paypal, you sent money as a gift!!

Sorry to say its not looking good, what proof do you have that you paid for items?

i would think she will be able to prove she payed for it via paypal account??

like gumbo says i have proof through paypal account mind you it is not looking good :bonk:

No, you have proof you sent someone £300+ quid as a "gift."

I'm sure she can, but its a gift!

Shell,

Just to add, I really hope you do receive your camera, I have also paid for goods using Paypal gift........... Never again.

Paypal Gifts are still logged with your account, you have the Email address of the person that holds the Paypal account, I just payed for something on here with Paypal gift and it shows up in my account, theres a unique transaction id, the recipients name & email address.
FWIW on the bottom of the transaction details page there is a link to the resolution centre so it seems you can seek help. Whether you have any success, I wouldn't know, but I wish you well anyway.

Yes, indeed, but as a "gift", not for the purpose of buying goods. Paypal (& Ebay) are very specific as to what should be used for what......... so I would favour Lord Lucan winning the National on Shergar over and aboard the dispute centre being of assistance....... however nothing ventured, nothing gained. For the purpose of an email or phone call what is there to lose?

Also, there is a chance the camera will arrive, though just seems with the lack of communication / action etc by the seller.... then i am thinking more than likely otherwise. Hopefully I will be proved wrong though as we're not talking a tenner.

On the basis of the other threads, I think it's only fair to continue to give him the benefit of the doubt.
It was only Wednesday when he said he'd arrange to send it out. So it wouldn't have been posted until Thursday / Friday at the earliest. It's quite possible that it wouldn't have been delivered yet.

Personally I think it's a bit premature to call the police in . . . but then again there are clearly things that set alarm bells ringing.
A lesson on following the rules to everyone using classified I think.

Fingers crossed that it eventually works out (for everyone concerned)

Hasn't Shell been waiting well over a week?
He's had long enough, if you are going to sell kit then once you have someones money, get off your arse and send it, there an no excuses.
He had enough time to post the camera before reappearing on the forum to defen himself.
Post offices are open on Saturdays, parcel companies will collect from a private or work address.

I'm trying to be sympathetic towards your position but I'm really struggling.

You sent payment to someone who wasn't the OP of the for sale thread, you broke forum rules and then you jumped into tarnishing his name before even making contact with him over the phone (ok you sent pm's but people aren't on the forum day-in day-out). You've since made contact and after just a few weekdays of not receiving the goods but believing they'd be posted you've persisted in labelling him a scammer and passed his details on to the police (prematurely in my opinion). I appreciate the sale is far from perfect and there is plenty to raise concerns of dodgy dealings on your part but to air all this is public simply isn't fair.

I hope you reach a happy conclusion and the goods in the condition they should be but to bash j4m13 before you know he's pulled a fast one is very wrong, especially given that you've made mistakes too, and my instinct is that this isn't a scam.

Take a look at this thread if no itraders they post first that's MY rule no matter what. that how i started with a sale to smoothedit.

I think that HiddyBiddy was expressing an opinion that anyone who dispatched an item before it was paid for (as you suggested) could quite rightly be considered to be an utter moron.

Standard practice on A/V forums for people with no feedback to post items before payment. And very few people get caught out by it, unless of course the buyer is also a low or non feedback buyer.

Completely agree with you.
It's been 9 days and Shell is quite right to be angry about it - I'd be fuming.

I just think that it's a bit too soon to be making the leap from "bad seller" to deliberate con artist.

how have i broke the rules? and as for j4m13 not being a con man how come he told me he sent the camera through his works when he doesnt work for the place he is ment to work for and also if he and whittie have nothing to hide why dont they answer my calls or texts also j4m13 did say he was going to let me have the tracking number so where the heck is it? no wonder i cant trust them both :bang::bang::bang:

I think this is what it refers too as in post #5

I am confused, who did you make the payment to?
If it was to j4m13 then why, you know the rules for selling on the forum (seeing as you have also sold stuff here) so you know the 100 post rule.
I really do hope you get this sorted out but the sale thread should have been reported to a mod and it should have been closed before the deal was done.

Doesn't that only apply to sellers?
Buyers do not need a post count.

the seller was breaking the rules selling for another person, the other person was breaking the rules for not having enough posts to be able to useclassifieds. No-one reported the posts, so we were not aware, otherwise they both would have lost classifieds access

when making a trade, we ask that a lot of details are taken to protect both parties, it doesnt seem that you got all the info, otherwise you'd have an address and a landline to go chasing down

Hopefully the items will arrive monday.

But sellers do, and in Jamie selling via another member that did have over 100 posts he broke the rules. The rule is there so that stuff like this doesn't happen although I still think that creating a knee jerk thread about how they are both scammers, apologizing when they get in touch then when you don't receive it in a few days starting EXACTLY the same thread again is a poor show...
