Request to use my picture

Hi all,

i received an email today from a painter that wishes to make a painting of one of my pictures. Now for the life of me i cannot fathom why she chose this picture, but she has..

Her website

Now this looks genuine to me, and i don't take pictures for any financial benefit, and in light of the fact she does some prints for charity I'm minded to tell her no problems.

Any thoughts?

First of all, congratulation on being asked by this talented artist. I've seen her work first hand and can vouch for the quality.

You've re-opened an oft-visited can of worms here - should you give it away for free of charge her? I'm gonna sit back and open the popcorn in a minute and see where this thread goes :)

If you really have no desire to earn money from your hobby then give her what she wants, otherwise ask for a payment - simples! For sure though, whichever you decide to do you'll be both villified and applauded in equal measure by the good folks on this forum.

Just do what you feel is right for you.
 
the fact that she makes money from her paintings I'd say yes in exchange for cash
 
Why not ask her if she's doing the painting for free?

Well i just mailed her asking how much she will be selling the prints for...


ps as i do potography for a hobby, i see little financial value in my pictures, but since the painter sells her paintings...

On a slight tangent, i used to dj over 15 years ago, and was annoyed at the amount of promoters that expected dj's to play for free when they were making money from door fees. I made it a point then never to play for free if the promoter was making money. I dont have that attitude to my photography, (yet..) but i can see how others do.

I know, but i wanted to put the ball back in her court as it were. Im not sure what to do so having a conversation with her maybe the best way forward.

Not sure why you should worry too much about how much money she might be making. She'd be the one doing the painting, marketing and selling it. If you want to make money, then you sell the image. And good luck with that... ;)

BTW, as a DJ did you pay music artist royalties?
 
It's your photo it's up to you, if she's doing the drawing /print in order to raffle off as a prize to help a charity then yes, but looking at the prices she charges there's only only charity where thats going I personally would say no

Good man :) That's what makes the world go round. TBH she's done you a big favour simply by asking, and paid you a nice compliment. She could very easily have copied it anyway, flipped it left-to-right, changed the colours and altered the mane or something and you'd never know. She would then also be (arguably) in the in clear as far as copyright is concerned. Plus if you get a signed print, well, job's a good 'un :)

On the music royalties thing, yes another can of worms. The whole world of copyright is a huge can of worms - and snakes. You certainly do need a performing license to play stuff like that in public, and for reward. I'm no expert on that, but whatever the legal position might be, the moral fact is that you were trading off other artists' intellectual property.

Frankly the prices that she charges are rock bottom for the standard of work that she's doing, and way under what I'd charge for a pet portrait photograph. Also it might have escaped your notice, but she does seem to actively support charities with her work.

She's in the process of illustrating a book. If the work's going into that I'd be looking to discuss a more formal, financial arrangement.

IIRC, most of the time, it's the venue that pays the PRS license fee and that covers all music played and/or performed there

I'm with a lot of others here, say yes but ask for a signed print or a donation to a charity, as I did with one of my pics a while ago. I gave them one of my pics for a donation to 'LIVES' (emergency first responders) and the jobs done.

As for the records, if it's a mobile disco you run then you're supposed to pay the royalties, if it's a nightclub or similar venue there's a fee worked out as part of the licence to operate (not bar licence).

Good luck on whatever you decide, but at least enjoy the feeling first.

When I ran a pub, I would have had to have an entertainment licence if I were to put on a disco e.g.
PRS were paid yearly and you would have to declare, such things as discos/live music, Pop quizzes with music tracks, background music, TV, Radio etc. etc etc. Even the Piano, which was in the snug added £47 pa onto the total bill, just in case someone lifted the lid and played a few keys...Oh yeah *** too'... A DJ running a disco would have had to do their stuff playing their records and tapes and not have to worry about all that was what I understood.

Like you say though, possibly another can of worms and not relevent for this thread.

As for your suggestion about be my guest, for a signed copy, I agree given what the OP has said.

If she's selling several suggest a percentage of any she sells..... if she refuses get a signed copy and a cuddle. Win win
 
Weirdly, i have had another request from another painter to paint the same photograph...

Never did hear back from the painter above though.
