I thought I'd asked this the other week but can't find the post so forgive me if I'm repeating myself as I need to clarifythe situation. I'm putting together a calendar for a motorsports club and one of the photos is of 2 marshalls at the finish line. They new i was taking the photo although they probably didn't realise (neither did I at the time) that it would be going into a calendar and I would be making a couple of bob out of it. Do I need a realease from them or do they give away their rights because they were at an MSA event in the same way that me and Rob do because of who our employer is?

Yes the calendar will be sold. Technically the MSA hold the copyright but I'm dealing with that (or atleast trying to). The championship chairman who is responsible for the events has said that even though I don't have an MSA license he gives me permission and will take any flack should there be any (which I don't expect but I'm trying to cover my arse) but I'm not convinced that would hold up in court should things get too serious.

I was hoping that the marshalls because they are officails at the event might have given up their image rights in the same way footballers do? Any ideas.

The other thing is he now wants the drivers names underneath their pictures. Orignally I didn't need releases for them because they weren't identifiable by their faces but now I don't know.
