I was reading an article in the farming section of a local paper tonight. Seems our Scottish government is going to do something about saving the native Red Squirrel. Even had a picture of one. One of my pictures. That has got there from who knows where! Ach well if it gets the message across that will be payment enough.
 
You should contact them to ask where they got the photo. Even if you don't mind them using it, they should have asked permission!
 
Without a shadow of a doubt you should contact them and tell them they do not have permission to use that image.

Then explain to them how they can get your permission... And make sure they pay higher than standard rates because of the situation. Your images are top notch - don't give em away.

Its one thing for you to send them an image and use it, its a whole different story them trawling websites and stealing images !

I hope you "manage" to get recognition at least ( you certainly deserve it!)
 
Your images are too good to allow them to use them for free, let alone no acknowledgement
 
Great news about your picture being published Charlie; but a bit cheeky of them not to ask first.
 
I think it's worth finding out where they got the picture from, might be the tip of the iceberg so to speak. I'd also ask where to send the invoice if only to educate them their law breaking :thumbs:
 
Someone on a craft forum that I use has just had a present from Getty. £1900 bill for the unauthorised use of 2 pics on her website.

She's getting lots of "helpful" advice on why she doesn't need to pay and that Getty can't enforce the bill. It will be interesting to hear the outcome.

That happened to someone I know rather well
They just kept sending the demands back
after about 12 months Grotty got fed up and dropped it that was about 12 months ago now

Wouldn't you want the money if someone used your images? Why shouldn't Getty sue for theirs?

2 grand for an image that "resembled" something they had on their books? I don't think so!
If anyone thought that any of my images were good enough to "pirate" I'd be flattered not annoyed :thumbs:

They can't reasonably enforce the bill, the cost of enforcement will outweigh the cost of the bill. If it goes to court, they may well suffer costs, or even outright defeat. (Fair use is open to quite a lot of interpretation by the judge)

No one use of an image is worth £1900

Exclusive rights to a unique image, maybe. But not that particular instance.

In any case, copyright is a dinosaur and needs to be stopped before it stilts the next part of the societies evolution!

By all means write to them asking for acknowledgement and informing them not to do it again. Don't wack off an invoice unless they're being pillocks about it to you.
 
So the images weren't Getty's?

It had been altered, quite dramatically, by persons unknown and posted as a joke. With a funny caption
the person I know had it stored on their web site along with a lot of other funny images and getty "found it" and put in a claim for just under 2K of un-authorised use
