Photographer stopped from taking beach photos

Because somewhere is a public place does not mean you can do what you want.

I can not think of any activity that a council undertakes or is undertaken on its behalf when you do not Public liability insurance (PLI). (Councils see everything as a perceived risk)
So if you are doing something "commercial" on council controlled/owned land you will need PLI.

I'm not questioning the facts, I'm questioning the reasoning behind it. If somewhere is open to the public and those members of the public are allowed to hold a box with a lens on the front up to their eyes and press a button without needing insurance then a professional doing the same thing should not need insurance as the risk is the same.

If only that were the case. I belong to a group of hobbyists that tried that tactic for more than a decade, with assurances from central government that they had no plans to introduce legislation that would affect us.

Since 2000 three wide ranging laws have been enacted which have all but decimated our hobby. Why? Because those who would see us prevented from carrying out that hobby countered our low-key stance with a high profile anti- campaign.

The unfortunate consequence is that these new laws affect every person in the UK, whether they want to engage in that hobby, or not. Any legislation intended to prevent photography in public places will likewise affect every person in this country - whether they own a camera, or not - and will be yet another nail in the coffin containing our freedoms.

Yeah, you got the soap box out too late. I strongly believe that the laws which inhibit you are as daft as any legislation to prevent photography in public places would be, so they'll probably be foisted on us.

I dont agree with that comment at all unfortunately. It's that self effacing attitude that seems to empower the jobsworth into thinking he/she can order you about without any just cause.

I've only been stopped twice but both times I've simply cut them off and said 'Either show me what you've just said on paper or disappear sunshine'. Yeah its not going to win any popularity votes but if it gives them the impression you are fairly confident in what you are doing. I suspect I'm about to get some unfavourable replies about what I've just said but I'm sick of people armed with a badge at the end of the lanyard thinking they can boss people about and I wont have it.
 
The beach is a public place. I can go onto a beach with exactly the same equipment as a professional photographer and take pictures without needing insurance.

The beach is a place to which the public have access, which is a bit different, and to be fair to the council they are only saying that those using Council property for commercial activities should seek permission.

That doesn't seem at all unreasonable to me.

They haven't said anything at all about preventing photography per se, they are interested in commercial activity on council property.

The foreshore at Sandbanks does belong to the Crown, so the Crown would have to say what they feel about commercial activity there rather than the council (though you need to cross council property to get there unless you arrive by boat.)

Not all the foreshore in the UK belongs to the Crown, but I'm sure that bit does.

We either bend over and take it up the a?*se or fight back. And I'm buggered if I'm going to give in to some petty local authority Hitler. (pun intended).

If we all had that attitude in the past we'd be flying the swastika and singing Deutschland uber alles by now!
