Hi everyone, I've a wee problem which someone may hopefully supply a solution to.
I take photographs of flute bands during Parades. One of the bands is holding a charity day in aid of CHAS. I would like to donate a selection of photographs I've taken from various Parades covering a number of bands. The idea being that the photographs are sold and the money goes towards the charity.

Talking to my College tutor he informs me I can't do this. He says I would need a model release form from everyone who may be recognised in the photos. This is impossible, due to the sheer number of bands and others in the shots.

Will I just need to put this down to experience and think of another donation, or can anyone suggest a legal way round this.

I don't see there being a problem with selling the pictures mate, it's surely the same as selling, say, a street scene which has people in it? a landscape which has a person in it, or a scene from anywhere really?

I think it's a great gesture to help make some money for the charity and don't see why anyone would object to the idea.

I'll be taking part in the charity parade on the 1st October, if you get any good snaps of our band i'll quite happily make the donation to chas for them.

Your tutor is wrong. Feel free to donate away and support the cause,

Thanks for the quick replies. Must admit I'm surprised as my tutor seemed certain that this was a no go. Just don't want to get myself into expensive litigation, been reading the professional photographers site (-: . What band are you with Peter, may already have photos of your band? Feel free to pm me if you prefer.
 
Your tutor reminds me of a driving instructor from Bolton who insisted the national speed limit of a dual carriageway was 50 mph.

Why to people who are teaching us not know the laws of the subject they are teaching ??

Seriously tell your tutor he needs to brush up on his knowledge of the law. You have every right under the law to sell your photographs as works of art or editorial images (even if they include recognisable faces). What you're not entitled to do is sell them to the commercial sector for use in advertising.
