other photographer copying my work

Would appreciate thoughts on this, its not really copyright theft but it has seriously peed me off.

I photographed two weddings recently. One of the brides is a 'friend' via Facebook. I noticed today that she had been 'tagged' on Facebook by another photographer whom I had not heard of.

I went into this photographer's page. She advertises herself as a wedding photographer and has wedding albums on her page.

In the wedding albums are pictures from the two weddings I recently shot.

The images aren't mine, but they are identical in that she was clearly standing behind me photographing shots that I had set up.

I was the main photographer and was not aware of other photographers being there.

This photographer is implying they were the main photographer and that they came up with these 'fantastic' ideas/shots.

I'm very angry, but what can I do? :bang::bang:
 
I would get in touch... outline your problem see what results..

If not then OUT THEM to everyone and see how they like that..

Otherwise i doubt theres much you can do in real terms :( But wait for other replies.. I am sure they will vary :)

Annoying. Really annoying. I think the direct approach, complete with screenprints of the two web sites, highlighting the factual innacuracies in the OP's statements, while confrontational would at least get the matter straight out into the open. You don't even have to be nasty about it, simply pointing out the things that you have a problem with and thanking her for being so complimentary about your style ;)

Gramps, I dont have a problem with guests taking photographs, thats fine as long as they dont get in my way too much, however this girl on the day WAS getting in my way and was told to leave us alone to get on with our work. We didnt' realise at the time she was a photographer. She's on her facebook business page saying "here are some recent weddings where I was the photographer..." and others are replying saying wow thats a great idea, great shot etc. We set up those shots. It was our idea. We are used to guests putting up pictures on facebook, the issue isn't her taking photographs, its the implication she came up with the ideas and was the sole photographer. People are now posting on the bride's pages saying how wonderful her photographer seems to be, her photographs are wonderful. People think she was the main photographer and she wasn't. I'm going to get some of OUR images up asap (still editing)
 
I cannot see that this is a copyright issue unless you have a specific type of photo that no one else has taken :shrug:

It is a right cheek thought and if nothing else you may be able to get them through the ASA for false advertising and misleading potential customers, but they could get round that with a short bit of small print on there site, I thing the only thing you can so is name and shame them :lol: but I'm note sure that will do you much good other than make you feel better.

I'd send a request to have them removed :thumbs:

If that's the case then it's not just annoying, it's fraudulent!
 
I was a photographer at my friends wedding - I was not the "hired one" but they asked me to shoot for them.

I would class that as being a photographer at a wedding.

does the OP know for a fact that the bride didn't ask them to take pics for them

yes we have a few poses that are unique to us in this local area at least, she's copied them exactly, in that she was standing behind us.

ASA is a great idea, will mention that to her. Just trying to find the best way to word things.
 
She was a guest and I think one of the brides at least knew she was taking photographs.

I am angry that she is presenting herself inaccurately and passing our ideas off as her own.

I've managed to get pictures removed by facebook in the past and will try again.
 
There is still nothing you can do. You get this at car photoshoots. people stand behind you and take pictures of the scene you've set up. I could not care less if they do this.

If she was at the wedding no doubt she was invited, so normally at liberty to take photos from any vantage point. Unless you arranged an exclusive photo shooting arrangement with the bride I fail to see how you can castigate someone else for taking shots at the wedding. Just be thankful you got the job and the bride didn't ask her friend to do the shoot.

Sorry but...Didn't her camera give you any clues? First you never saw anyone with a camera.. then you saw her and she was getting in your way.. Confused.

Yes we have it in our contract.

I noticed cameras, there are always cameras at weddings, what I meant was I was not aware there would be another 'wedding photographer' there. I assumed she was a guest who kept standing in front of us etc and I asked her to give us space. Now I see she has used these images to present herself as the sole photographer at these two weddings.
 
Everyone's got a camera at a wedding, plus these days everyone seems to have a 5D mk2 or a 7D apart from me :(

Not sure what you can do? Have you had a quiet word with the bride saying you've noticed someone saying they were their photographer. Are you concerned about losing out on prints etc if they have identical shots?
 
I dont think its whats in the contract and i doubt sales is the problem and it doesnt matter what the rules are or whatever... what matters is that this other person is pretending to be the official tog and i agree with the OP .. I would be furious for that alone..

"a photographer"/"the photographer"

There is a difference, however seems less than clear now what the situation is. If the o/p was the sole photographer then that's what he was and anyone else claiming to be that would be making a fraudulent claim. If however the other photographer was asked to take other photos then that would be different - depends what the facts actually are.
 
Dont lose any sleep over it if the shots came out of her camera then theres no copyright issue as the clicks are on there cards not yours, i would just forget it where ever you go this will happen and beating you balls up not worth it.

This woman was a guest, so it's a reasonable assumption that she is a friend/relative of the bride and/or groom. I'd just have a word with them, and tell them you're not very happy about the way she's representing herself as their wedding photographer. Not much more you can do about it, really.
 
TBH, can't see the bride or groom falling out with a family member/friend becouse the photographer is not happy with them for taking Similar pictures or telling porkies on facebook.

Actually that was not what I said, the OP said the photo's were on her own site, I took that as website and as such a request being sent to her not facebook they are her photo's so she is under no legal obligation for her to take them down this is why my main point was to consider the ASA, as due to recent regulation changes in relation to online advertising this is now also governed by the ASA

You did 2 separate weddings and this woman was at BOTH doing the same thing?....
 
Yes two separate weddings. I wasn't as aware of her at the first wedding compared to the second when she was much more in my way. I thought she was just an annoying guest/friend until these photographs appeared.
 
I'm surprised so many people in this thread have fallen for such an obvious wind up thread. Reeks of BS.
 
Just post on her and the brides website that YOU were the official tog preferably with some additional pictures to make it clear to everyone and make her look like the liar.

I have got to ask but is this thread some kind of wind up... Pirateship you have only 12 posts and half your posts are about this and the other half about a Florists complaints about her flowers been in your picture asking you to remove them
you have no website no posts no images or anything you sure get a lot of drama going on with your photography

There is totally and absolutely nothing you can do to stop her and you will make yourself look a fool if you do.

But you can grasp the opportunity and use it to your advantage, think laterally.

Does it matter if it is Joe?

Its a subject that effects many of us. Not me as such because at 6'3" and 24 stone and faster than an Olympic athlete when shooting others can neither keep up or see around me :lol::lol::lol::lol:

Yes and say something like, "I see you were standing behind me when I was the official photographer at this wedding, glad you liked my groups enough to take them as well"

It's not a wind up or a fabrication at all.

I do have a website, if I choose not to share it, that has nothing to do with me being false. It makes sense in this competitive industry to be unknown, to have nothing traced back to you. Especially if any legal action is planned.

Thank you to the nice people who offered advice.
