Old images taken with a compact being used without permission (Copyright Again Sorry)

Just curious really.

Back in 2005 I went on a cruise on our honeymoon and took a photo of the front of the ship. I put it up on my personal website for a few years

Now I havent compared it yet but there is a very similar photo if not the same one on the dailymail and maybe on another website.

Now back then I didn't think of anything like putting copyright notices on etc.

Do I have anything to stand on if it is my photo?

I have to wailt till im home as i've taken it off the my website now.

So even if i've not added any info embedded into the file I may be able to do something about them having it on their site for about 3 years?
 
Oh yes - you can invoice them for lots of money if it's your pic. Copyright lasts from the moment you click till 70 years after your death!
 
So if it was mine how would I prove it? I know I'll have the original file but would that have some embedded info that would show it was the original?
 
But how do you prove it? If the image came from a stock library for instance after being stolen in full size from the OP's website, how could you prove that you took the pic and not the person who licensed them with the stock library?
 
If you have the original file and they don't then you are on to a winner.

Once you have established it is your photo then get screen grabs of as much evidence as you can then send them an invoice that is at least double the going rate for using the image.

They won't have a leg to stand on.

Then the stock company would be in big trouble for selling something for which they have no permission.
 
The original file may have the camera serial number embedded. It should also have the date/time the original was taken. Do you have screen grabs of the alleged offence? You should also set the copyright info NOW in your D700 - so it is easier to prove ownership in future.
 
Well I intend on doing it the moment I get home so that wont be till 6pm.

it doesn't! I've searched for loads of pics when I knew there were multiple uses out there and it never finds them. Great idea - but right now pretty useles..

Yeah, it depends whether its been indexed but its worth a try

If the only result is the one on your website then either the image shown on the Daily Mail hasn't been indexed, or it may not be the same image
 
1. Take screen grabs of the offending pictures before you do anything else!
2. use the alamy calculator to work out a fee for each use - based on length of time used and size used
3. double the above for unauthorised use
4. invoice them
 
Invoicing is pretty useless without at least the threat of taking legal action and being prepared to follow it through.
 
I've found it works - they get the invoice - they pay - they usually can't afford to let it go further. You may need a covering letter explaining that if you don't get paid in 30 days or whatever then further action will be taken. I can honestly say I've had a 100% success rate in cases like this.
 
It's the Daily Mail - you'll get offered standard rates and that's it.
 
That pretty much outlines the ongoing cases. It was Welfoot that I was thinking of the most. He was offered £135 for an image nicked from Sky News Online if I remember correctly.

Ah i think i found it. Somewhere between £170 & £200 i guess according to their calculator.
But you think i'll only get offered £40 even though is been on there since the end of 2008?
 
You should aim for what the calculator says - and be prepared for less - remember two I would invoice double for unauthorised use. Good luck.
 
well in total I found it on 4 web pages (different sites)
Some of them have used a re-sized image but actually have the full size image under the thumbnail
 
Have they copied the image or are they linking to your site?
