What the press don't appear to have latched on to yet is that there is a clause in the Data Protection Act that allows individuals to seek compensation from a data controller for loss, damages or distress caused as a result of the mishandling of data.

I'm sure a legal expert will tell me that HMRC are exempt from such action, but can you imagine the fallout from every child benefit claimant seekin compensation for the distress they have suffered!
 
There certainly is mark ;) I'm sure that somewhere government departments are exempt. There will have to be proof that an individuals data has been lost, not sure that a whole CD containing everyones data would cover that. However, if because of that loss, someone's Identity got stolen, they'd definately get hit with a large claim!

I suppose it comes down to the interpretation of distress, I feel quite distressed at the moment!
 
Exactly. I'm not condoning what these muppets have done, and I think the ICO should hit them with a huge fine, which comes personally out of the chiefs wages, rather than just the taxpayers footing the bill.

Unfortunately the ICO is a bit of a toothless tiger as the fines that can be imposed are pretty minimal, so much so that some organisations will put poor data handling down as an acceptable risk because it would cost more to improve their security than pay a fine.

The FSA on the other hand have far greater powers over financial institutions - I think it was Nationwide that got fined almost £1m a few months ago for losing a laptop with unencrypted customer details on it - and as such banks etc usually have much better handling procedures.
