New Copyright Law Proposals

The new proposals are:

* To simplify the current copyright system, including licensing practices by asking rights holders to broaden their terms of use. For example, a wedding photographer should allow a couple to share their images with their friends online.

* To allow non-commercial use by individuals without the need to ask permission for that use (third party organisations such as charities, as well as blog receiving payments via advertising, would still need a license).

* To reshape the enforcement strategy by making it less ‘muscular’.

* To educate the population on the consequences of infringement both on consumers and rights holders.

* To allow an organisation to act as a collective licensing agency, which will license all works in a particular category (music, film, photography, etc.)

I signed this earlier today, as a bit of a side note, does it take a while to update the amount of people who have signed it? It was 461 when I signed it earlier too and I know others who have signed it.

Not sure if its already been posted here (or if I'm posting in the right section) but the UK Government are planning to change laws on copyright which will in effect make it legal to "allow free and unhindered reproduction of photographs without payment or credit on non-commercial websites". Goes completely against their whole anti-file sharing stuff!! Was announced on the 29 October 2009.

From the bit I just speed read, it looks like the unlimited use for non-commercial could be an unwanted side effect of the strategy. They appear to be considering how derivative works, orphaned art and such like should fit in, with what is and isn't allowed to be clarified so everyone knows what they can and can't do. Seems a bit on the wooly side (as these report things usually are considering the money they spend compiling them), but it's quite interesting reading.

Oh, and signed the petition as well. All for clarification, provided they're not taking away any of the artist/togs rights at the same time - There's usually a response to these petitions, looking forward to the official line......

Just read the above link, the part I find most disturbing is this

Anything that includes the words Sympathetic, and Europe Wide give me the willies... Definitely won't be getting any sympathy from me.
 
Apparently the whole "orphaned image" theory will be disregarded if images don't contain a watermark, IPTC or EXIF data embed in the file.
 
Blimey......glad I am not there! But then again we seem to be 2-4 years behind the UK and everything bad is ending up here! :(
 
We do have a point at this time where there are many laws that are unenforceable or simply impractical. As lets face it you go on any forum or just about any persons computer and the odds are there will have a photo with out permission that is probably copyrighted. Possibly this is a attempt to streamline the law but from a quick look I don't really see it working all that well if this is what they intended.

I think thats a bit cheeky really. So as long as I strip the IPTC info from a file I can use it "non-commercially" as its an "orphaned work".

Perhaps if I cut the 20th Century Fox bit off of the front and end of a movie I can then give copies of it to my friends as an "orphaned work" too.

Oh hang on, I won't be allowed to do that because the movie companies are "big business" and I'm only a photographer.

Maybe the rights payment collection scheme is a good one... you know like the PRS... and like with the PRS how much money do you think I'll ever see from it even if people are actually paying licence fees to them...
