I was watching Springwatch tonight and did a double take when Chris Packham held up a print of one of my photos!

I checked on my Flickr and they had asked if they could use it, although I had not replied by the time they showed it, and they also did not credit me, which I find a bit naughty.

Congratulations, I was watching it. Cheeky beggars for unauthorised usage though. I guess it depends what your default settings are on Flickr.

I think they said it was a new insect...

Well done for getting your photo shown. As far as no credit and defending the program, the presenters do tend to rush through "viewers images" unless it is part of a competition so I wouldn't get too hung up on not getting a personal message.

As for the content of your image, for me it is another good reason to avoid emigrating to Aus. What with all the poisonous critters and now bright orange snot worms I would never get SWIMBO out of the house!!!

Well done on getting your image on the programme. You could try not to half flatten the poor thing next time though. ;)
 
Having looked on Flikr I note that you have it © All Rights Reserved, in which case usage without your permission is a breach of your copyright.

I can't see how having your copyrighted image shown on a national BBC programme without a credit to you brings you any benefit apart from personal vanity. This wasn't a "viewers image", there is no excuse for non-payment.

You are looking at £150+ for a TV usage on the BBC (based on personal experience), I'd be doubling that for unauthorised usage.

It is probably an "administrative error" that having sourced your image they included it into the show on an assumption that you would agree - but the simple fact is it shouldn't have been used without confirmed permission.

I'd be right back to the person who contacted you getting a contact name and an address of someone to send a bill to.

I submitted it to the Autumnwatch flickr group a few years ago, and apparently, in the T&Cs, this gives them permission to use the pic.

Ah well that changes everything. You are bound by whatever T&Cs you agreed to.

Personally I'd be removing it from the group. It clearly is a rare enough / good enough image to be used...
