Monitor Gone Bust.... again!

It may help if you quote the Sale of Goods Act directly to show them you know what you are talking about:

The Sale of Goods Act 1979 Article 14(2) says:

(2A) For the purposes of this Act, goods are of satisfactory quality if they meet the standard that a reasonable person would regard as satisfactory, taking account of any description of the goods, the price (if relevant) and all the other relevant circumstances.

(2B) For the purposes of this Act, the quality of goods includes their state and condition and the following (among others) are in appropriate cases aspects of the quality of goods—

(a) fitness for all the purposes for which goods of the kind in question are commonly supplied,
(b) appearance and finish,
(c) freedom from minor defects,
(d) safety, and
(e) durability.

Thanks!! It doesn't really say what I was saying about warranties, but backs it up none the less :)

Regarding the liability of the credit card company, section 75 of the Consumer Credit Act 1975 applies:

"If the debtor under a debtor-creditor-supplier agreement falling within section 12 (b) or (c) has, in relation to a transaction financed by the agreement, any claim against the supplier in respect of a misrepresentation or breach of contact, he shall have a like claim against the creditor, who, with the supplier, shall accordingly be jointly and severally liable to the debtor."

In this case breach of contract is as covered by the Sale of Goods Act above.

(Please note this is not professional advice :) )
