man freed

so up until the point the 'burglars' (which I would say is a bit of an antiquated term, this was what our American friends would call a 'home invasion', which can get you shot and killed over there!) left the house he could have got away with pretty much anything.

Well actually, he couldn't have got away with pretty much anything. it still has to be proportionate. If you are threatened, you are entitled to incapacitate him but, once he is incapacitated, you are not entitled to continue the assault.

On that we agree:D

I have no sympathy at all for the burgler and am glad he got bashed.

However the law is clear that you can use reasonable force to defend yourself and your family and , as photo plod said, a jury of ordinary people like us decided that he had gone over the top.

I was sorry the man was jailed as I'm sure, having just seen his family being threatened with a knife, that he acted under severe provocation. Now he has been released so I think justice has been done. His brother is still in prison because he didnt have the same level of provocation - they were not his wife and kids and I believe he didnt see the incident.
