Do you mean as you are a consumer who is missing photos? Or a photographer being chased?

I think he misunderstood the issue - it sounds like he thinks the shots are missing due to their being deleted from a card and thus if recovered there'd be no need for arbitration...
that aside i can't help with theissue at hand as 'the guild' are a new one on me - if i had missing shots i'd sort it out with the cliet (or with the contractor if i was the client) directly

Some details would help.
If you're a consumer going for arbitration the only advice is to be clear what you want at the end. Just be aware that you can't get 'missing photos' that are totally missing. Complain all you like but if they don't exist, no amount of negotiation can create them.
