What is the situation these days with candid photos of people?

I would like to display them on my site and allow other people to use them if they wish. I did not have permission to take the photos. There are various shots ie some close ups of people/couples at a festival, horse and rider at an event, dog and handler at event, motorbike and rider at event, people at a railway station, etc.etc.

Bearing in mind that minefield called the data protection act...:rules:

1. Am I allowed to display these on my website?

2. Am I allowed to say to my visitors you can use them if you wish?

I'm no lawyer, but as long as the subjects aren't extremely famous and shown with their children; aren't identified by name (particularly children); aren't used for advertising; weren't photographed where such activities are disallowed -- then you should be OK. I ought to clarify for myself about cases where you want to commercially exploit without a model release e.g. for greetings cards.

You can allow others to use your work, but it's better to provide a specific licence and avoid getting in the habit of giving too much away.

i beleived that if its your image you can do what you like.
 
My understanding is if you put yourself in a public place you surrender your right to privacy.
