If the contracts are not signed then there is no agreement. Really, it should end here.

If you signed her copy of the contract, then you're in for problems (possibly).

So...did you sign, or did you not sign the contract. And yes, a signature needs to be there or else it's just a printed piece of paper. If if it amounts to just a piece of paper with no signature, print your own and state something like "Miss Model agrees to give all her earnings to Mr. Photographer."

Don't be stupid now. Think this through logically. As much fun as it is reading a 6 page drama thread, it really doesn't have to be this way.

Good luck.

You really need to see a lawyer. The advice you are getting on here is, as has been said 99% junk. Contract law is a minefield, and a contract does not have to be signed for you to of accepted it.

Then ultimately it's Miss Model's word against Mr. Tog's word. And judging by how the actual printed contract looks like, it doesn't seem like Miss. Model's word will be very strong.

But true enough, I'm even from a different country and your British laws may have nooks and crannies that common sense just won't be able to comprehend.

In that case, and if you're really this concerned, do see a lawyer and learn from your mistakes.

is that the actual wording of the contract if so the word taking is used incorrectly, it states that any photos you take from now on she'll own copyright to and that you are entitled to 10% of the profit she makes from her website regardless of whether you've taken the photos or not

it's a string vest mate get it to a legal boff and tell her to **** off, also quality isn't mentioned so like everyone else has said send her the pictures in super low res

or as i understand it from a conversation we had earlier *ahem* wasn't that one of the days when you forgot to take your lens cap off? and hadn't put a cf card in the slot and shot on demo?

- all this is after reading 1.5 pages btw so if i'm a bit out of touch ignore this -

Sorry it happens to be your post Alex but I'm fed up with this type of suggestion. This happens to be an open forum and who's to say she hasn't been on here and screenprinted the posts?

The OP has already posted one image, agreed to meet to give her the rest, but didn't. Quite frankly, to suggest that they don't exist, or to tamper with them, is ridiculous.

He needs proper legal advice to advise whether or not the contract he signed is valid and enforceable, end of.

After reading the entire thread I'm inclined to agree with Dod's latest reply and say enough is enough, Get some legal advice from a suitably qualified person be they CAB or a lawyer.

I'm going to ask that this thread is left alone now until such a time as the OP wishes to raise it again with an outcome.

Best regards to all

Brian

Well ive taken all the advice on board, ive since emailed the model in question and said 'im taking further advice and will of course update you soon'. It is a rather messy situation, but hopefully il have this all straightened out soon.

Does seem a tough one ... Unfortunately all the good faith appears to be on our part only.

Best of luck getting it sorted by a professional.

has she seen the final images already because if not just give her crappy photoshopped images and theres nothing she can do as legally you have to pay the costs which means she wont get any studio costs back and she never paid for the images themselves.

The contract says nothing about the method and medium that the images will be supplied in.

Notify her that you have the images available and invoice her £1000 to cover cost of cutting them to a CD.
Once paid you can then release them to her.

Tristan, I'm going to close this just now to avoid more replies giving potentially wrong advice.

If you want it opening again once you have an outcome drop me a PM :)
