Legal advice?

I picked up a bag of peanuts the other week and it says on the packaging warning this product may contain peanuts or words to that affect
I had to laugh
A peanut isn't actually a nut, but as places that pack peanuts usually pack other types of nut, there's a risk of cross contamination, so the pack will warn that it may contain nuts/traces of nuts.
 
I am anxious to hear what the OP has to say about all these answers to his question. It has been around around 36 hours, and he has not responded. In fact, my anxiety is growing by the minute. This is causing me great distress and mental anguish.

I may sue.

if you know you have an allergy then it is your responsibility to avoid whatever it is - you can't assume that something is safe to eat - you need to check with the person giving you the food that it is safe.

if this was done and the person giving you the food was mistaken then they are at fault.

otherwise, in the words of my parents (many times over) 'it's your own fault'

so until we have more details we can't advise really...
 
I think the lemon tart did it.. The flapjack is getting a bed rep from all of this.
Those lemon tarts have always been shifty.
 
The problem with nut allergies is that they can change over time, what maybe a mild reaction one time can turn into a fatal reaction the next, i'm afraid all the bakery have to due is proof Due Diligence, ie that they have done everything reasonably practical to ensure that allergy sufferers are protected, if they have a sign up in their shop thats says that products may contain nuts then i'm afraid they have no case to answer

Honesly, I'm glad you're OK. But the last place to ask for serious legal advice is on an internet forum. The vast majority of people on here are normal upstanding members of society.. but they're not experts on the law!

Craig i understand your frustration at your son being able to have his sandwich... but put the shoe on the other foot.. say you found he was allergic to nuts too?? bet your the first in the q to get them banned.. sorry but i have been there done it and seen it.
i understand what you are saying but give a little consideration to the people that have to deal with these things.. sorry to go on. i could name some recent stuff that would make you pee your pants..

Not frustrated, it's justnthenway health and safety Uk has gone mental, wonder how they got on when I was at school? We used to get dirty and run around and each stuff of the ground, surprised we all made it......

Anyway as someone said a peanut isn't a nut, so not sure what happens with that one.

has the OP been into his local sweetshop and bought a packet of reeces peanut butter cups and eaten them, hes been very quite as of late, perhaps hes having a reaction.

Im alergic to shellfish (which is a b****r I bloody love prawns etc) i havent had prawns for 10 years now, although about 2 years ago i tried a prawn (i wanted to see if i still reacted) turns out i did, worse than ever! (apart from prawn crackers which i still consume and have no issue with!)

Its a b****r but i simply cant eat anything with prawns in, and for that I have to be REALLY careful!
