Well its happened, talking about motoring offenses earlier this year with a group of friends, they found it amazing that all the miles I do (75K p.year) I have never had any points or fines for traffic offenses, as I started driving at 18, some 47 years ago, I went up to Edinburgh very early last Thursday, got away about 10.30am, then had a leisurely run through the Borders on my way home with my camera, stopping at two or three places of interest taking pictures..........this morning I received a letter telling me someone had taken a photo of me, Lothian and Borders Safety Camera Partnership, got caught doing 65 in a 60 on the A68 by a mobile camera, best of it I have a Road Angel and know every camera on that road, did the crime, pay the fine...guilty as charged :(:(
 
65 in a 60,that seems a tad harsh,do they not have to give you 10%?
 
I always believed there was a bit of give, but what it is I don't know, think it depends on the Police area, wrong time, wrong area, wrong speed, pay up and force a smile
 
sounds harsh to me , but as you say , you were caught fair and square , annoying though :(
 
I do believe it's 10% leway allowed: 5 for your speedo and 5 for the camera.

65 in a 60 is hardly the end of the world is it?

Fair play, it`s over the top but by 5mph in a 60 limit? I always thought it was 10% plus 2mph for a nick. May be they`re short of cash up there......

Is it points only, or can you go on the speed awareness course?

In other news, I was absolutely convinced I got caught by a van on a three lane carriageway three weeks ago. I was certainly well over the top - haven`t heard a peep. It`s done me a favour tbh, it`s slowed me down a fair bit.
 
Sounds really harsh IMO

I was told the 10% rule was for officers stopping people on the roadside (and its only if they feel like it, nothing in the laws) if they want to be arsey they can fine you for 61 in a 60 for example

Its still a really harsh one IMO after all your "clean" years driving

Where I live in Canada, I've been told that they have a privacy law which prevents the use of such cameras as it's considered an infringement on your privacy to have a photo taken without your consent!! Have never seen a speed camera and I've been here for 7 months. No-one sticks to the speed limit though.
 
I would say thats extremely harsh going by your impeccable driving record but the cameras are there to gain money so just cough up and dont complain as it will double...........safety cams my arse ATM more like
 
Actually the ACPO guidelines say the prevailing limit plus 10% plus 2mph should be the lower limit for prosection which would make it 68mph before you should get knocked off, so it's a bit harsh to say the least.

ACPO (Association Of Chief Police Officers)put out guidleines to all forces on lots of subjects, the idea being to standardise the treatment of offences across the country and different forces. The problem is it's just that -advice and individual forces aren't bound by it neither are individual offcers.

Many forces adopt the guidelines - others don't, but even in forces where the policy is adopted, there's nothing to stop an individual cop doing you for 31mph in a 30 limit if he's so minded, and once you're reported that's it - speeding is an 'absolute' offence so unless you can throw doubt on the evidence your goose is cooked.

Assuming you don't intend to travel to court, I'd be inclined to write to the court pointing out your clean driving record and the fact that while you admit the offence, it doesn't comply with the spirit of the ACPO guidelines.

Can't do any harm although I doubt you're in danger of too harsh a penalty. ;)
 
I agree thats harsh and certainly didnt used to be the case around here when my late husband was a traffic cop ( 20 years ago). Times change though and the cameras dont use discretion, and make a lot of money.

One of the other money makers, parking fines, is even worse nowadays, with council officers waiting to jump on you for even a minor infringement.I've been caught by them a couple of times.
 
my friend lost his license on 2 tickets 35 in a 30 and 75 in a 70 (first 2 years only get 6 points)

well harsh in my book
 
Speeding in a 30 deserves what he got,JMO.........:)
 
Scotland is a dodgy place for drivers, fixed and mobile cameras all over the damn place. I am extra careful when I am north of the border although I am not a speeding driver it is sometimes easy to slip over the limit be a few mph.

One thing I have found when driving inn Scotland is that if there is a warning of a camera ahead then there will be a camera there, unlike here where there are so many false warnings.

My post was not a moan, but it just goes to shows not to temp Providence when your on a winning run, learned my lesson a little late, just wanted to retire with a clean licence, after all, a posible fine of £60/ 3points over 47 year isn't the end of the world. As long as I don't have to retake my test again, where would I get a Standard 8 car from. :lol:

Speed cameras incorporate the 10% allowance as far as I'm aware, just don't take my word for it. You won't be able to argue your case by telling the judge that "niligan said so...........":lol:
 
LOL. Ford Prefect mine was. :D

I'm not defending speeding, I've had a clean licence for well over 40 years, but I'm not always an angel so it's a bit of a lucky dip.

Now if they put a camera on every set of traffic lights they might actually do some good. Red light jumping seems to have become a national sport with no-one doing anything about it. :suspect:
 
i believe it's 10% + 2 at the discretion of the force of jurisdiction.
all insurance companies work their prices on the assumption that we have 3 points
so no biggy, bummer but not disasterous
think about the last 10 years that you have been subsidising the speeders :p

and my sympathies but 47 years is too long to keep your cherry :D

The relative regs allow the warning signs to be up to 6 junctions away. That can be many miles.
 
Just had a closer look at the paperwork, the speed camera, sorry, safety camera, number as come up on there website as a mobile camera, no wonder my road angel didn't warn me, and I know all the fixed cameras on the A68 as I use the road about a dozen times a year....moral of this is don't rely on the camera detector, must have started to get to confident in my old age.
 
If you were clocked at 65 your speedo was probably reading around 70mph , my tachograph is calibrated but the speedo isn't and they're about 5mph out at 60mph

this place is rapidly becoming a police state with their bloody cameras situated in the most money generating sites.

I've never seen one outside a school or old peoples home, it's easy to sit in a van £60 and 3 points or £150 speed awareness course KERCHING.

A guy I knew is a drunk, no other word for it, he got done for drunk driving, 12 month ban, after 9 months he went on a drink awareness course and got his licence back, a couple of years later he got done again, 3 year ban, after 2 years he can go on a drink awareness course and get his licence back, if it didn't work the first time why the **** to they think it's going to work now, of course they'll be a few hundred £££ better off so that's OK then, the government has created all these civil service jobs so they need victims to pay for them

Speed/Safety Camera's are great for revenue making aren't they. 65 scrtainly sounds harsh.

I just wish I got £60 for every photo I took. :D

It's harsh because it's a money making exercise, 5mph on a national limit road is crazy and a sign of the money grabbing police state this country is becoming.

I drive for a living, every day without exception I get people overtaking me at 40+ in a 30 limit, again daily I see people jumping traffic lights, not just on amber but when they've been on red for seconds.

If they're so concerned about road safety they'd be addressing these serious problems not sat in a layby catching people 5mph over the limit.

I'll agree with that one.

I find it strange that people who generally want to see zero tolerance on all crime think it's o.k. to break the speed limit a little bit.

I wonder if the people saying this was a bit harsh would also agree that a prosecution for shoplifting was a bit harsh if all the person took was something cheap.
