laws on newspapers

I am not disagreeing that you are also breaking the terms of the license agreement, to that there is no doubt. However, it most certainly is also theft, maybe not from your mate, but from the artist, publisher et al and is why we have the PRS in the UK to stop this kind of theft.

That hasn't happened here. Its not theft. A common miss-use of the word is to blame for this, or perhaps a "rebranding" by the MPAA et al.

I make no apology for stating this.. but that comment is the most ridiculous crock of tripe I have ever read.

So... you make a copy of a mates CD, and while you're at it, you also make a copy of one of his DVD's. According to you, you are not stealing, just mis-using the terms of license... phah, what a total load of rubbish. Of course you are stealing, and I am 100% certain that the music publisher and DVD publisher would concur.

I was under the impression we were talking about photographs not music. I stand by what I wrote. Scottishpaul still has his images therefore they have not been stolen from him. Someone has apparently used them without permission which is a different thing.
 
This was copyright theft. The invoice should be for his normal repro fee plus 100% for copyright theft and that should be stated on the invoice.
 
so i sent an email to the reporter who wrote the story. i didnt put my name or say i was writing on behalf of myself pretending to be someone else. i was just arguing what he wrote in regards of the story. which i knew, as it was me who done it haha.

as for invoices, how would i go about doing that. e.g price, documents etc?
as i said this is my first pictures that have been published. not quite the way i would of expected or liked them to but you know its happened so tough titty.

as for the bickering. i dont think what anyone has wrote is wrong. just everyone has slightly different points conflicting to others which is understandable as not every human is the same.

If it was me, I would send an invoice - simple. I appreciate your concerns, so the decision is yours. As many others have requested, let us know what you decide and how you get on should you choose to invoice them.
 
Absolutely send them an invoice....they have big budgets.

Oh, its only a few pics......and if you have a local business and you want to advertise in the paper - it is only a little business, but you still have to pay for your space.

Send an invoice for a MINIMUM of £250 for a one time license to use - a retrospective license is always more expensive than an up front one. Do not let them get away with copyright infringement. They are in the business of publishing - they know the law inside out, and they know they cannot just lift pictures without the copyright owners permission (license).

That same scenario goes for any originator (pictures, words, paintings, sculptures).

Just because this copyright theft goes on all the time does not mean it is admissable - we must emphasise that using pictures without a license (permission) is nto going ot be tolerated. It is theft. Plain and simple.

im looking for someone who has been in a similar situation to contact personally who can help me with the whole shenanigan.
for example. how i go about sending them an invoice, price, other details etc.
i feel i might aswell send them an invoice as i have nothing better to do ha. plus i may get some money and they must know in there own right what they have done is wrong and were just hoping i wouldnt notice.

as by sending a invoice is a bit like saying yes it was me. but as it said in the paper there has been no complaint to the police, just sais council are investigating it. and ive got to the stage where most people knows its me and if anything was to come of it, it would of happened by now.

so if anyone would like to give us a hand out of there own nice heart :)
i would really appreciate it.
 
How about looking at it this way...

If something is going to happen to you with regard to trespassing (I seriously doubt it so long as nothing was damaged and nobody harmed) then it will happen no matter what and it won't be the newspapers who action it.

So why not make a few bucks in the meantime? If you ended up being fined then the money would be quite handy!

thats the way im looking at it now. nothing to lose, who dares wins and all other macho sayings:lol:

well it will be some experience on dealing with newspapers. which cant do me any harm.
as i said i could do with as much help possible with regards to invoices etc.
because that thing natjag posted is very long :D.
