Last week the local newspaper decided to run a story about a venue that I had photographed a dance show in. They used my photo (which I had sent in after the dance show), but didn't credit me or anything, so I emailed the photoeditor explaining that I wanted payment for the photo as it had been used out of its original context and that the metadata had my copyright in (thanks to info found on here). The editor came back and told me to submit my bill for £15.

The photo was quite small so I'm not too bothered about the amount (and there is only one newspaper company in Cumbria) but my question is how do I lay out the bill. Is there certain details that should be on it?

Usual personal/company details and those of the pic ... and the amount of course but you certainly want to include a copyright retainer on it imgo Allan ... ... to prevent further unauthorised usage ...

it needs the word INVOICE, date and what the invoice is for
prob worth including your address, and payment terms
suggest 30 days terms, late payment 3% above bank rate
if adventurous, offer 2% deduction for payment within 15 days

Whats the best way of wording that this invoice doesn't give them free use of the photo ?

If it has your copyright in it and you haven't signed it over then you should be safe already? :shrug:

A phrase like "Distribution rights remain under sole ownership of the artist, no further reproduction is permitted without prior authorisation", should cover it, I think..

Put an invoice number on it too.

Make sure the invoice states.

"Use of Image <Your reference>, Description : <Your description>, for one print run, date, whichever magazine/newspaper, and size.

Particular cost."

It must be grate to get an image published.

You should really, only use the word invoice when your dealing with an already established post payment account ... If otherwise, you should just stick with the word 'Bill' for a bill. Far less hassle and your not inviting some to give the excuse that they thought they had 30 days to pay because its was an invoice.

...don't put vat down at all, unless your vat registered....just the final figure.

You can put payment terms at the bottom of the bill, saying something like 'Outstanding amount payable immediately'

Many thanks folks for all the help. The bill is now complete and ready to send - we'll see how long it takes them to pay up.

Spencer - Metadata is the info help inside of the photo - like the Exif, but has details of copyright, where the shot was taken etc.
