Incorrectly credited photo

Just need some thoughts on how to approach the publication / paper about this mistake, as I have never had it happen to me before, And not very tactful about such things.

I went along to a local cycle hill climb a few weeks ago and too a few pics, having had a chat with the organiser of the event (small local cycling club) I said I would send him some pics for use on his web site under the condition I was credited with them, which he agreed to.

Sent said pics and conditions on email to him.

I get an email back a few days later asking if he could use 1 or 2 in an article about the hill climb for the paper I said yes he could but only if I was credited for the picture in the article.

So I read the paper and find 1 of my pics used along with a pic from someone else, and both are credited to him. (I later find out he is the papers staff tog.) Well I wasn't happy about it but its not the end of the world.

I'm just wondering what's the correct way of handling it and what usually happens in this situation, as I have never had a picture wrongly credited before.

The file contained a file name with my name in it and the metadata was full completed.
 
It could be an honest mistake, give them a call and see what they have to say.
 
Only today have I had the same thing happen, these things happen - if there's not money riding on it, I probably wouldn't bother to follow it up, unless it's got right up your nose.

Very similar to what happened to me recently, after a bit of discussion the paper finally agreed to pay for using the shot. I would contact the paper and explain what has happened and that you're not happy. See how they react and what they offer to put things right.

The law provides "moral rights" which include a right to be identified as the "author" but in this case is (probably) exempt as the story was a "current event". The right not to have the work falsely attributed, however, stands which is a criminal offence.

I will be visiting them on Monday, the least they are going to be getting away with is a reprint of the picture correctly credited and an apology.
