i am not sure if this is the correct place for this thread but thought it could sit better here than any other part of the forum.
I have today received a request for the use of my image below in a brochure for a new housing development in Cambridge.
Crepes Make You happy by iain blake, on Flickr
The request for licence came from a graphic designer who is creating the brochure.
I am prepared to licence the image but had a few reservations about doing so which I detailed in my reply to him.
1 the lady in the image is easily identifiable but I do not have a model release form from her as it was a street shot.
2 the premises are identifiable too, I thought there may be some conflict with regards to their premises image being used in such a manner.
I am not entirely sure where any liability lies with such use, were I to just licence the image disregarding any potential conflict.
I don't think I would make much money from the image use but nevertheless, can do without a potential headache should things go a bit awry.
Anyone have any experience of such issues?
I welcome your views/opinions.
