i have just had a message off someone " on another forum " asking if they can paint or draw one off my images.... shere khan in animals and nature...

now i dont know this person ..
sounds a bit funny to me..

but :shrug: thay have not aked for the full res file so .. i suppose they could have just printed the low res shot and done it off that...

now this does open up a grey area... as the painting would be of you photo, who owns the copyrite? it would be theyre painting but of your photo? :thinking:

To be honest it is a stunning shot of a tiger - I imagine that someone who wants to draw a tiger (could it by any chance by someone at school or college with a summer art project) has spotted it, would like to use it and has been polite enough to ask if that's OK with you.

I don't know the legalities of copyright but I'd have thought that if you stated that they could use it for their own drawing but you retained the copyright that would be OK to keep the copyright on the photo (no idea about the drawing, presumably that would be theirs).

I think this may be taking copyright a bit far ... :shrug:

He could paint a picture very close to what your shot looks like and I doubt you would be able to do anything about it. I have some shots from the WHF event that look almost the same (not quite so good though .. :D)

At least he had the decency to ask.
 
i would be tempted to ask a few more questions and find out what the 'new piece' will be used for?

sounds fairly genuine though :shrug:

and polite with it :)
 
i think i will say yes just thought i would sound it out on here with some more experienced folk.

at the end of the day i am a amateur and if some one wants to copy one of my shots i suppose i should be flattered...:love:

It's not a copyright issue at all - it's an incredibly polite person asking if he can use your shot for inspiration

If I was a brush type artist, I'd just print it and work from it - never think to ask the owner - especially on such a common thing which as a tiger image

Don't worry about it, but do ask for a view of the final image - if he's really good, you can add "Animal Paint Portraits" to your sales pitch and commission him to work from your shots for clients

If for personal purposes then I would let them have the picture, if commercial request % of any sales.

He's not going to use the pic to sell it - he only wants it as a reference to paint from & thus creating his own copyrighted work of art, merely inspired by MD's image. Frankly I'm astounded he even asked permission

It would be impossible to keep tabs on anyway

It's a bit like photographing an arable landscape, and giving a punt to the farmer for creating it when you sell the photo later :cuckoo:

Best thing to do, as MD has, is say - 'No probs m8, send me a copy will ya' and leave it at that

As I see it copyright remains with the original author so to speak. because it would be a visual representation of an existing pice of work.
 
Mrs Frac does paintings from photos, animals and people, as soon as they are finished and she signs it, the painting belongs to her. The image still belongs to the owner.

To be honest it has never been a problem as people send thier images to her, she does a painting of the subject and the customer takes ownership.

I think the person asking is being incredibly polite by asking.

Duh copyright only lasts 75 years. LOL if he was still within this time-yes a royalty would have to be paid to the original copyright.
 
I'd let them use it and as Dave said ask to see the final drawing or maybe even get a copy of the drawing. Some of these artists can do very good drawings and sometimes I think they can look better than the original photo.

Just my tuppence worth.
