Gave one photo away asking for crediting me...guess what...Update

Hi.
I dont want to be a rant...Im just looking for an advice as this is quite awkward situation...

I work for Music Conservatoire...we have Junior department teaching kids aged 3-18 on Saturdays...2-3 weeks back I worked overtime on Saturday.
Because we had Henry the IX days on site I had my dSLR with me...
I was approached by Junior's Administrator if I could take a portrait picture of one of their students for their Final Concert leaflet....I said, Yes, no problem.
I said that I will give them this photo for their own use if they will credit me in this leaflet....guess what....they haven't !!

Thats a quite big leaflet...its A3 size booklet/concert programme...they charged for it...
All other pictures where taken by some other Tog and her name is mentioned on the second page...Photography by...

Im really..really crossed about it!!was it too much to ask for?!?! :bat:

As basiclly thats the same organization I dont know what to do :shrug:

I think about sending them an invoice..
have no idea how much to ask for...(ideas?)

or what to do...
I dont want to put myself into trouble:bat:

the student was under 18...So I dont know how does it work out if I had no parents permission...but if her picture is in this programme it should be fine...


Please help me out...any advice welcome!!

I would have a word with the person that asked you to take the pic, see what they say and then hand them the invoice!
 
I guess nothing can be done about it now as there already printed, but I would give them a ring and ask about it. I would be very mad if that happened to me!

yes its printed and it looks like this photo was taken by a Tog credited in it ...
 
They’re obviously happy enough with the quality of your work to print it and they will have paid the other tog so I think it’s only fair they pay up. The only other suggestion is they pay you in kind, perhaps a piece of togging kit, vouchers or some time off work?
 
I just had a word with my boss ..he is Head of Estates...he is going to have a word with them...I dont see any money coming my way but maybe next time I will be the one taking pictures...and then I will be credited..paid maybe...
 
legally they are treading very fine! its totally against copyright law Not to credit an artist for a piece of work, let alone in a situation like this where they have been specifically asked to do that...

I would send them a link to copyright law, stating how they have breached it and ask them for some compensation.

I would (and have) been furious when my images have been used without crediting me -

hope it all works out for you and they see sense and bung a few quid your way

Take a deep breath and ask for a pdf proof before it goes to print next time (common practice).

Just enjoy the fact that you got a pic published and in stiff competition by the sounds of it.

I think episode 5 covers your situation, worth a listen for definite. I'd be very careful how you approach this one though. I'd get legal advice before taking it any further, but also be very clear in your own mind what you want the end result to be.
 
one of my mates said that I should ask company that printed those programmes out, if they had permission to print my photo out ...if not, sue them haha

I felt it will end up like this...that will teach me...
I will see what they will say...depending on that I will forget about it or take further steps...

Thanks all for advice, and maybe that will be a lesson for others :)
 
Good judgment comes from experience, and experience, well that just comes from bad judgment.

Put it behind you, move on and never let it happen again without a signed contract.

You have been bitch slapped on this one, so what, your not going to become an International superstar photographer on this one and the few quid you gain will not be worth the fight.

The people who have mistakenly failed to mention you for your photography have helped to mold you into a semi (or) professional photographer.

Lose, learn, gain.
 
i don't think it's worth it to do much about it, but its so annoying when that happens! I'd probably just make a sarcastic remark about it next time i saw the person who agreed to credit you!
 
Life's too short to worry about things like that, be pleased they thought your work was good enough to print.

With all the talk on TP presently about likes/dislikes, tolerance of others opinions etc - and then we see posts such as this. You disappoint me HoppyUK, I didn't expect to see that from you.

The OP is quite reasonably upset after their pic was used without credit when they were informed it would be credited. He is simply asking what he could/should do about it, that's all. It may very well be a simple mistake, but then again it may not. Really... he's got no need whatsoever to 'get over himself', and you've no need to post that comment.

We're all trying to help others here yeah - but your post was unhelpful, intolerant and unnecessary Hoppy.

Did you take the photograph while at work?

If so you may be in for a surprise as there is a reasonable chance that your employer, who asked you to do this work while employed by them, can claim copyright.

Be cautious.

That post was probaly more helpfull than others.. they, mostly consisted of.. Sue them all. That would ahve really help the atmosphere at work.
 
It sounds like they regularly produce leaflets for performances. It looks like there isn't much you can do about this shot without risking your job but they owe you one now, so ask them to use you for future work with credits and payment. If your work is up to standard this could be the start of a beautiful relationship...

"He is simply asking what he could/should do about it." Yes, so I told him what to do about it, and to the OP's credit, he seems to have taken it on board. It was a slightly emotive, but then so was the thread.

That was my honest opinion, which was being asked for. Should I say nothing, or advise him to throw a strop and call in the solicitors, when I think that is a thoroughly bad idea? It's a simple photo that went in a leaflet. Perspective please.

OK, so you provided your honest opinion - which is good, but I just didn't think that for you to be insulting and say he should... "get over himself", was the most appropriate response you could have provided, that's all. In fact, I still don't... :)

I guess I could have expressed it a bit more diplomatically, and I never mean to cause offense, but at least the point was made.

I guess where I'm coming from is that it seems some photographers have a much higher opinion of their work than people do, mainly the general public. Rightly or wrongly they don't see or understand the importance of a credit, let alone the need to pay, and that kind of reflects the low value which photography seems to have these days. Hence the abuse, but it's rarely intentional.

Photography is everywhere, it's easy and everybody with a camera can do it. That's the perception anyway. I don't agree with it, but I'm not going to bash my head against the wall trying to change public perception. Do what I can, but then just roll with it.

There was another similar thread when the poster had taken photos as a favour, at a children's party I think, handed over a CD of everything and then found them posted all over facebook or something, without knowledge or permission. No harm had been done, no money lost, and the internet was full of nothing but praise for the images.

The problem was elsewhere; a liberty had been taken, control had been lost, the photographer was full of righteous indignation and miffed. But the photos were done as a favour, as a present, and they had served that purpose extremely well.

Maybe the photographer had another motive that had more to do with self promotion and ego than doing a favour. And that's fine, but let's be honest with ourselves, and others.

It's probably fair to say that in 99.9% of cases, only two people ever see pic credits. The person who typed it and forgets it instantly and snapper that demanded it.

I understand why you're disappointed bastic, I would be too, but it's not the end of the world. They know your name, they'll hopefully use your work again, and maybe next time you can earn something from it!

I had no time to speak with them or to remind my boss about it...I had my arm almost broken today by an upright piano!! 2 inches more and I would have it in two pieces !...
