Flickr and copyright issues of hotlinked images?

I know this may have have covered before but I'm a little unsure of things.

Firstly this french website has used my pictures. They haven't actually stolen them, but instead they are still hosted by flickr.

But what does this mean in terms of copyright?

Whilst I'm not annoyed at the pictures being used, its just the principal that I haven't given my permission or been credited on the site.

Any thoughts?

It happens all the time and while it's certainly a bit rude, there really isn't anything you can do about it.

..... other than change the image they've linked to to something far less appropriate for them. ;)
 
Its not like they are claiming it to be one of their own though, also its linked to flickr so you still get full credit for it :)
 
The site appears to be some kind of commercial town/city guide and is probably hot linking hundreds of images from flickr. Might be worth dropping an email to flickr reporting it as it probably affects a lot of their users. It doesn't matter that the site has hot linked rather than hosted the images, they are still publishing them without permission :(
 
Some interesting thoughts.

I think the first plan of action is to contact the website and ask them to credit me. As I said I don't mind, but I just find it a bit cheeky.

I don't Flickr would really care about it to be honest. They have mentioned the pics are from flickr and the thumbnails link directly to my flickr page so from flickr's perspective all is good as it does nothing more than advertise their site.

I do find the idea of changing the images slightly amusing :D
 
Does Flickr's T&C's say they can redistribute pics hosted by them.

It's definately copyright infringement as your photos are tagged all rights reserved.

Personally I would change the photos for something nasty about the french :razz: or at the very least adverts for deodorant :D.

Alternatively if you aren't as anti-french as I am and all you want is recognition you could put a copyright sign and your name and contact details on them.

Of course you are in your rights to start legal proceedings but I doubt it would be worth the effort. Perhaps a strongly worded letter may get you some money.

If you replace the relevant pics with an identical image, then the flickr link gets broken and their front page will simply have a bunch of red x's.

I think this also works if you rotate the image and then rotate it back again.

Do a search on the flickr help forum for something like: rotate breaks links
 
I have not complained to flickr about hotlinking but where someone has taken my image and put on their flickr website flickr have been very helpful and have removed the images.

Below is how they want you to contact them:

I wish to complain about a photograph I have taken that is on Flickr without my permission. The photograph is here http://www.flickr.com/link-to-pic

I have *good faith belief* that the reported use is not authorized by the copyright or intellectual property owner who is (insert your name)

If you have a pro Flickr account you can see the referrers to your pics in your stats.

You certainly can - I've just checked my and some filthy spainard has done the same to one of my photos :bat: (see link). The paella eating toad has even had the cheek to put on his site that all content is covered by the creative commons licence (unless stated otherwise - which he hasn't) :annoyed:.

Time to send a polite email requesting removal or credit and to update the image with one that has a watermark showing my copyright.
 
Happend to me as well a guy who wanted to be a wedding photographer used 10 of my pictures on his site. Also a music review site used some shots of a singer I had taken pictures of on there site.
 
how can you see if someone has used your images?
 
Go to your photos, then from the drop down, select the stats page, and then check the referring sites!

I am and I'm fine with the pictures being used. It would have been polite to seek my permission that's all.

I actually had a flickr user send me a message today asking if they can use some of my images in a music video. She sent me a link to her myspace (I hate mywaste) and she seems a bit of a nutcase from a quick preview of one her 'videos'.
 
I've had a few sites link to my pictures like this. I now simply watermark the pictures with my copyright notice and my URL so it's obvious where they've come from.

Frankly, I'm always rather flattered when someone thinks my images are good enough touse in this way.

I'm sure some people upload their photos and repeatedly hit F5 in the hope that someone will 'dare' to link to them.

IF YOU DON'T WANT PEOPLE TO STEAL YOUR WORK THEN STOP UPLOADING THEM TO PUBLIC HOSTING SITES.

Flickr is no place for drama queens.

But if you look back at my comments, they purely reflect the fact that I hadn't been politely informed about the use of the pics. I think this is called courtesy. It's not hard for anyone to employ this. Of course some don't expect this and some do (but those that don't receive it I shall now refer to as a 'drama queen' :suspect:)

Despite telling the French webmaster all I wanted was credit, he had over reacted and removed them, which isn't really what I wanted, but oh well.
 
I think it goes with putting your photos on the internet unfortunately. If you post photos of any quality I guess someone will link to them or use them in some way without permission. The only way I can see not to have unlicensed use is to not post them in the first place, even small pictures seem to be used for websites and copyrighting can be cloned out fairly easily too as I've seen in the past.

Whetever you do, don't be tempted to install Flickr Stats into your account, you'll probably have an embolism.

This was posted on another board I use today, interesting response from the site that used his picture...

Once again I see that one of my photos has been published without my permission in a local newspaper, only a few weeks ago I came across a rival property website using one of my photos on their Homepage! I contacted them for payment , more or less told to F*** off
