Hi, 6 weeks ago my son was involved in a serious RTA ,his right femur was badly broken (splintered fracture i think it was called ) up near his pelvis ,torn spleen ,he was put into an induced coma for three weeks because he developed a serious chest infection and couldn't breath for himself ,having sleep apnea definitely didn't help . Once he was brought round and conscious we were told he lost the sight in his right eye (one thing after another ......) .

The accident happen at 10.40 am in company time,he was sent home early because of bad weather plus he had a doctors appointment for a sore chest and cold ironically !! .

My son works for a very large national quarry company . He operates a loading shovel and looks after all the mobile crushing plant .. etc ....etc .

Anyways now you have a picture of what he's been through, my question is can the company pay him off because of his loss of sight in his right eye .

I'll also add ... he's only receives SSP ....but.... the company have appointed a Lawyer/solicitor to start a claim against the idiot who caused the accident ....who i might add got off scot free and uninjured B@5T@RD !!!!!

Bit long winded i know but i'd appreciate any advice/thoughts

Just to add he was in a company van

Don't ask advice here. Go and see a lawyer.

Sorry to hear about your son Sean, hope he is on the way to recovering ...

my question is can the company pay him off because of his loss of sight in his right eye .

If you mean let him go / lay him off, then it's probably down to a health and safety issue - depends on if you need perfect vision to be able to do what he does ? They may well see if they can find him other opportunities in the company if he cannot return to doing what he did.

the company have appointed a Lawyer/solicitor to start a claim

What / why have they done this - was he in a works transport ? is it the company or their insurance company that has done this ?

Have you spoken with them as to why they are doing this - is it to recover their losses or for the issues your son has been through / got...

Could be worth speaking to a lawyer / solicitor of your own - have you been in contact with your son's insurance company to see what help they can offer ?

Hope this is of some help...
