Hi all

Just a quick heads up warning for anyone buying on eBay

every one knows that ebay's protection policies hare heavily weighted towards the buyer but this new one should be noted with caution.

I just bought in a standard auction a Lumix flashgun that was described is in mint condition and full working order.

It arrived today and I found that it did not work, so I went to ebay to file a claim and was told that the item was NOT covered by eBays buyer protection even though on the Auction page it said it was.

If this is the way they are going I for one will no longer be buying on eBay again.

Anyone else get this

I did try through paypal but even they said that because I had asked the seller to take it back |I could not file a report with them either.

Could this be the straw that broke the eBay Camels Back, it is for me

Try contacting ebay through another means?

Simply put, you should be protected

Hi all

well after spending nearly 2 hours on live chat they finally admitted there is a problem with their system which is stopping me reporting the item and that it sould/might/hopefully be fixed by the 29th September, I should then be able to report it as faulty.

The seller is refusing to accept its faulty though, its only been used three times how can it be faulty she said. By packing it away for a couple of years with the batteries leaking away is how I said.

Really? (Genuine question BTW).

That has always been the biggest issue for me with eBay and misdescribed/ faulty items.... If it doesn't arrive you have a gold plated case for a full refund. However if it arrives and you admit receipt of it by making a claim that it is faulty, the best you get from eBay (generally) is the "send it back recorded at your expense and you'll get refund" but still be out of pocket the return postage.

How are eBay able to take the return postage from the seller and give it to the aggrieved buyer, or do ebay cough up for the return postage?

therein lies the problem, they are obliged by law to cover return postage costs if item is faulty. however how you get this back i have no idea. i would only suggest that you tell them to arrange collection of faulty item so put it on them. they can easily book a my hermes collection for a few quid.
i know theres a certain time frame for them to collect and if they fail to do so then the goods can effectively be scrapped and dont have to be returned.

What should you get back?
The original cost of the outbound postage to you should always be refunded by the seller.

The seller's terms and conditions or returns policy should state who pays the cost of returning the item.

If they don't state this, then the seller has to cover the cost.

In this case, you're entitled to a refund of the total amount you paid, including costs to ship the item to you, and the fee to return the item. No admin or restocking fees should be charged.

Returning faulty goods
If you receive faulty goods and wish to return them, The Distance Selling Regulations are in addition to your other legal rights.

So, if your goods are faulty and don’t do what they're supposed to, or don’t match the description given, you have the same consumer rights under the Sale of Goods Act as you have when buying face to face.

Any terms and conditions that say you must cover the cost of returning an item wouldn’t apply where the goods being returned are faulty.

applies to any/all .. only time rules are different are business to business selling.
buying from a private seller you have exact same rights as you would buying from a dealer or business
 
To me that would just drive up the cost to take account of the percentage of idiotic buyers who try it on and swap your good device for their faulty and then send the faulty one back. I've had that twice now, and whilst I record serial numbers twice they found in favour of the buyers.
 
Perhaps this is their way of leveling the playing field, now they are not letting buyers complain either.

Because of this I have just made my first purchase on Amazon and was quite surprised to find the item I was looking for, a Raynox DCR-150 was a good 25% cheaper on Amazon than it was on ebay. Which probably explains why so many of the things I have bought over the last couple of months on eBay have arrived shipped from Amazon.o_O

It does pay to look around ;)
 
I'm now using ebid too. Site's far from stylish but it's quite handy. Had a few things from there now, haven't started selling on there yet though the last few items I have on ebay are ending today. There are far too many stupid people on ebay and it costs me far too much to deal with them.
 
If everyone stopped using s***ebay they would soon change their ways, it will never happen of course but i can dream :)
